Three words: CHAIRMAN ARLEN SPECTER.

It was a fatal mistake to ever let than RINO get a chairmanship of committee which is this important to all of America. Bush' refusal to publicly disagree with anyone has resulted in another goatf*ck on nominees.

I also plan to tabulate the number of days from nomination to confirmation for these nominees.

It is also key to recognize that the confirmation rate is what matters.

This emphasizes how the liberals are using delay tactics to destroy the nomination process.

I agree that Sen Spector is not the ideal man to lead the Judiciary Committee, but we do not live in an ideal world.
Politics is the art of the possible. Ronald Reagan was always willing to settle for half of something than all of nothing.
In many states the election of a true conservative is a difficult task. If the Republican Party will not support moderates, the chances of retaining control of the Senate are slim, and I prefer a moderate Republican to a liberal Democrat.
To borrow a aphorism from LBJ, its better to have a moderate Republican inside the tent _____ out than a liberal Democrat outside the tent_____ in.
These tables demonstrate the absolute necessity of retaining the Senate in 2006. And they demonstrate the necessity for winning the 2008 Presidential election and retaining control of the Senate in 2008. If the Senate can be held in 2006 and for eight years after a Republican win in the Presidential elections of 2008 and 2012, the federal judiciary can be reconstituted.
Lets not forget that most of the Clinton judges will retire within the next decade or so.
It is essential they be replaced by men and women who respect the Constitution as it was written not as people want it to be.

Great stats and your hard work should have been done by the RNC. How can posters get out this info to voters before Nov.?? It would show not only Specter as not the quickest chair to get these nominations up and confirmed before a possible Dem takeover. Also, it would show how the Dems have slowed down the process and blocked great candidates. Still, W has not even put forward many nominees for openings already present. Those stats should be published also.

No one expected O'Connor to step down.

No one expected Rehnquist to have held on through all his cancer woes. Had he been cured, he would still be on the bench.

Also 3 vacancies of the 19 current were previously held by Bush 43 Nominees.

1 Vacancy is from the John Roberts seat on the DC Circuit.

Alito's seat has been filled by another Bush Nominee Michael Chagares.

1 Vacancy - Susan Neilson died shortly after her confirmation to the sixth circuit - very sad

1 Future Vacancy is from Timothy Tymkovich of the Tenth Circuit.

I generally agree on the half-a-loaf theory and I could have written many of your words myself they are so close to my own thoughts. But Specter would not have gotten that chairmanship without W stepping in and backing him. And the only thing he got out of it was a guarantee that Specter would not block his Supreme Court nominees. But somehow W never secured a commitment NOT to stop all of the other nominees whenever the Dems whined and an agreement NOT to spend the next four years investigating the White House over liberal nonsense.

The only apparent downside in dumping Specter from that Chairman spot would have been the bad press we would have gotten for 'purging pro choice' members from leadership. Yeah, I can just count all the great stories they wrote about Bush supporting liberals in the Senate. We got absolutely NOTHING on that deal and it still pisses me off.

Great job compiling this info.

Bush has done a good job with his Supreme Court picks (assuming everything we and he think is true) and he has had numerous high-profile conservatives confirmed to the lower courts, which is great.

Most of what we know about those picks was generated by the controversy surrounding them, i.e., the Democrats attacks and conservative support brought out a lot of information to enlighten us on their judicial philosophy, record on the bench, etc.

What has me concerned is the nomination and recent confirmation of Milan Smith. He is clearly not a conservative, has no judicial experience, and was a real estate lawyer. His claim to fame appears to be taking a position to the left of Pete Wilson when he was on the labor board in CA. His chief qualification is being Sen. Gordon Smith's brother and he was enthusiastically supported by Barbara Boxer.

That's a long-winded route to a troubling question, what do we know about many of the past and current nominees? From what little info I've been able to find there are several nominees that could hardly be considered conservative (e.g., Ikuta) and a lot of talk that very few actual conservatives stand any chance of confirmation between now and November. If the Democrats, PFAW, etc. do the freaky deaky on some of the nominees, what does that say about the others who sail through?

I agree that Spector has not been the ideal chairman, but he according to committee rules, he was the senior man. I am not wedded to the seniority system, for it has many flaws. But I'm willing to allow it to operate as long as the person is not attempting to sabotage the program of the Party. And I don't believe that Spector has done that.

Milan Smith is also 63 years old.

He will achieve senior status in less than two years.

His pick may simply be a bone to Gordon Smith, Oregon Senator and brother of Milan Smith.

You don't think Specter has attempted to sabotage the party? Sabotage might not be the right word but certainly he is as much of a liberal activist as Biden or Leahy. When Specter was questioning Justice Roberts he was indistinguishable from Kennedy, Schumer or Leahy. The Judiciary is historically a partisan committe but usually you have a partisan who represents your own party. Specter is a free-agent who spends as much time on their side as he does on ours. There isn't a single 'moderate' on the Dem side on that committee because they KNOW what that committee does. Yet, we have the most milquetoast "Scottish Law" following liberal member of our committee membership leading the cabal. The guy should have never been given a spot on that committee in the first place since he was never an GOP ideologue and a questionable legal mind.

But we could have had Jeff Sessions as the chair instead of Specter. The alternative wasn't a Democrat but a real republican by just bypassing the seniority rule. Frist and Bush just punted on this to avoid bad press. And now we get the lowest rate of judges in over a decade and investigations of the NSA that Dems requested.

Arkansan tapped for 8th Circuit

Bush nominated U.S. Magistrate Judge Bobby E. Shepherd, who has worked for the U.S. District Court for the Western District of Arkansas for nearly 13 years, to replace another Arkansan, Circuit Judge Morris Sheppard Arnold…. Shepherd will be an able replacement, Arnold said Monday. “Judge Shepherd has an excellent reputation among members of the bench and bar in Arkansas. All of us on the 8th Circuit look forward to welcoming him,” he said….

As I've said many times, I'd prefer a conservative to chair the Judiciary Committee, but I realize the validity of political considerations and the necessity for keeping the wheels of the Senate working smoothly.
There is nothing wrong with including political calculations in any decision involving governance.
To pretend one can govern otherwise is naive.
The art of governing people, even if you're a ruthless dictator such as Hitler - is a political art.
However, it is not solely a political art. There are other qualities, which are too numerous to mention here.
For some, however, one quality takes precedent over all others: ideological purity.
Junking people aside for ideological reasons is a tactic of the Democratic left. Do you wish to emulate them?

That does not mean that we are perfect or pure, or can operate far outside the normal range of the political art. The best Republicans - Lincoln, Reagan, Dirksen, Millikin - were men of principle who understood politics and played the art with consummate skill - and were men who served this country with great distinction.
