FReeper governsleastgovernsbest, AKA Mark Finkelstein, will be on the Lars Larson Show this evening at about 6:30 EDT. Lars and Mark will be discussing the NY Times leak of the government anti-terror program designed to track terrorists' financial transactions.
Time permitting they might also get into the amazing ability of Democrats and their MSM friends to switch gears without missing a beat. For months they have demanded a troop reduction. But as soon as there are indications a reduction might be in the offing, they criticize the Bush administration for timing withdrawals for political purposes! Campbell Browns interview with Gen. McCaffrey on this mornings Today Show, which governsleast wrote about at NewsBusters, was a good illustration of the phenomenon:

They have a thread on Sunday Morning for Andrew Wilcow (WABC). The posters noticed that things mentioned on the thread were being said my Andrew on the radio. So... the "posters" decided to find out if he was watching the thread. They kept saying things like "If you are watching us FReepers say "persimmons" After awhile, Andrew finally said "persimmons" on the air. So now, "persimmons" is a "cloaked" shout out to FReepers! Silly I know!
We await the day that Tony Snow says "persimmons" during a White House briefing! ;-)

Not exactly sure when the Persimmons started, but i know I've heard it used when a talk show radio host is also on a Freeper thread he said "persimmons" to acknowledge he was monitoring the thread. Think I heard it first from a replacement host on the Mark Levin thread. Correct me if i'm wrong TOL!

Here's my feeling on the New York Times and why I feel they can be prosecuted:
People are confusing the idea that you can't restrain someone before publishing, with accountability. If memory serves (you need to check this out if you like it because I'm going on memory from many years ago) - the pentagon papers problem was the government wanted the right to preapprove publication. A horrible idea. It would put a censor in every newsroom.
Today's situation is different. The NYT published what they wanted. The question? Can they be held responsible for that choice. The answer is obvious.
For example, if the New York Times told a columnist for the Wall Street Journal that they were going to publish his column and not pay him, they could publish it. It would be impossible to stop them. But, after the fact, the wronged columnist could sue the New York Times -- and win. It's not "prior restraint" -- the New York Times can't be told not to publish, but they can be held accountable for what they do publish. In the case of the columnist, they can be sued. In the case of treason, they can be arrested, tried, and put to death. The right to publish is just that: the right to publish. Nothing more. The New York Times can't publish copyrighted material without legal consequences and they can't publish national security information without legal consequences. They are not above the law.
