Upon further study, I found that in 2005, the Congress exercising it's Constitutional authority to limit the court, withdrew authority for the SCOTUS to have jurisdiction over these matters.
While I personally feel this unwise, it is the law of the land. I still standby my views expressed, but in this case, if my information is correct, the "ruling" has no legal status because the Court had no Jurisdiction.
The Military is free to proceed.

You are correct on this. I didn't know about the jurisdictional issues until later in the day, when some commentators discussed it. I think it is about the most dangerous ruling the SC has issued in a long time. The legislature took jurisdiction from the SC. They said they had it anyway. Outrageous, and were I the President, I would tell the American people that the ruling was null and void. The President doesn't get to violate the Constitution, but neither does the judiciary. The only check on the judiciary is when people tell them to go to hell. That will be rare if they maintain their credibility. At this point, they have lost it, and entered into the political arena.

The media would go nuts, of course, but if you explain it the way Reagan used to, the public would go with him, and the court would stop doing this crap.
