You are correct. I forget what the exact term is but one thing they can charge a military person with is dereliction of duty in these cases. Of course someone has to prove that a person saw it.
Taking the fifth is supposedly the same as Article 32 rights

Sorry. Our rights under the Fifth Amendment are supposedly the same as Article 32 rights for military. Just thought I'd clarify, even though most know what I meant in the original post.
