As for this not costing him the election, I think you're absolutely right. It still doesn't mean that this wasn't election tampering, whether successful or not.

The campaign spends about $100 to $150 a month on Web hosting services with MyHostCamp, said Dan Geary, who administers the site for the campaign. WTF? No way are they getting enough bandwidth to handle the level of traffic a bellwether Senatorial campaign site gets right before the election.

I was also going to say that that was not enough money spent to handle traffic on any decently hit site much less a candidate's site right before he goes up for an election.
Also, I don't see any way shape or form that this could be construed or that anyone could be punished under the guise of tampering with an election.
Possibly other things but tampering with the outcome of an election. The basis for my thoughts? Websites for politicians are not a Right guaranteed by anything(even though the average liberal thinks Internet access is a guaranteed right to all people on the entire Earth).
But I could be wrong. It has happened in the past...once!
