When debt collectors go too far

With all the recent news stories of debt collectors landing in prison or being taken out of business for illegal and strong arm tactics, I thought i'd share with my fellow Freepers a great resource to help if you ever have to deal with a scumbag debt collector.

I hope this is helpful to some Freepers who've been hounded rightly or wrongly by this pretty much unregulated billion dollar a year industry.

They may it all depends on who you speak with and what mood they are in that day.

Basically the law says that correct information must be reported but discretion is still left to the company to report the information. A common tactic used in debt collections is to get a payment negotiation on the condition that the credit report is cleared. It takes place every single day.

It never hurts to ask and yes, they can remove the negative mark if they so desire.

The laws are there to protect heirs. Of course any medical expenses the deceased owed at THE TIME do have to be settled as well as funeral expenses and the grave marker and taxes on the estate. But for the rest - no, the heirs are not liable for the debts of their deceased parents or other relatives. After all debts are discharged, technically the estate is no more and has passed on.

Funny thing is part of the lawyer practice is collections related. He's even frustrated at how difficult it's been to get this mess taken care of.

But I bet it doesn't change the way his office handles collections.......sometimes the lawyers' offices are among the worst offenders.

Don't worry - when you shuffle that mortal coil, that becomes someone else's problem to deal with. What do debt collectors do - visit the cemetery?

I get a call every morning from a collection agency out of California asking for my mother-in-law. They've been told in writing and verbally that she no longer lives with us, is in a nursing home in Texas, is on full disability and has full-blown Alzheimer's, congestive heart failure, end stage renal failure and diabetes. They still want me to pass a message to call them.

I'm at my wits end on dealing with this particular company. They don't care about the laws, we've sent them cease and desist letters, have complained to the FTC, the State of California and the Better Business Bureau and they still continue to call.

Have you tried the consumer Protection office of the Attorney General's office? Sounds to me like this is harrassment, plain and simple.

If you have caller ID why do you even answer the call? I just let those kind ring or if I feel mischevious I'll take the phone off the hook and let it sit for a while.

This site has a lot of useful info on how to handle debt collectors. Including letters on ceasing contact.

Because of my husband common name we ended up buying a credit monitoring service. Anytime someone looks at our report, a change is made or something is added or deleted we've sent a message.

Be careful with the foreclosure. There is a guy with the same name as my husband who also happened to be in the Navy (as was my husband) however he lives in California. He had a foreclosure on his home there and it went onto my husbands report.

We've never lived in California, never owned a home there, never had a home foreclosed on either. That one took months to get off his report.

Yep, we sent them letters, copies of phone logs of when they call and are now taping the calls when they come in.

We received a letter back that the state was investigating the situation and would get back to us when they had completed their findings.

I've seen his site and he does have good information however, even the best information, best letters etc do nothing if you have a collection agency that doesn't care about the law.

Basically it's cheaper for some of them to pay the FTC and State fines for violations of consumer rights then to change their tactics.

you have a big problem because the natural place to go with something like that is the consumer affairs office in your state which would be: 800-952-5210 (the Attorney General is 800-952-5225).

my experience with CA is that the consumer affairs office rarely helps consumers with debt collection problems. as funny as it sounds, you may wish to contact the consumer affairs office in Oregon or Washington State or from a state where an office of the debt collector may reside other than in California.

Post their name and number here. Post it to newsgroups and blogs. Post it everywhere and anywhere you can. Post it to sex newsgroups as a cheap phone sex number. Post it to hobby newsgroups as a place to call for cheap parts and info. Post it to gambling newsgroups as a free tip line. Post it constantly and continually under any pretext you can imagine.

My mother passed away two days before Christmas in 1989 .She was always a stickler for paying her bills.Being a private woman,not many of us children knew what was what.Then the collectors started coming.Some were dumb enough to think they could just start taking things!Not a good move!It was during the winter[Christmas],where they put your body on chill till the ground thawed.We hired a lawyer,who arranged to meet with the family to 'chop up the assets',so to speak.When the collectors showed up,the meeting place was a storage room for the bodies[o degrees]and the lawyer asked the bill collectors what is what questions they wanted my Mother to answer.They were all in shock,as they thought,they would be doing lunch,and so on.Needless to say,the bill collectors quit calling.

Consumers are URGED to make Richard B. Hunter aware of his stupidity by immediately sending the FREE cease communication letter VIA fax to his offices in California. I also recommend that you warn him that he will be held liable for any intrusions into your personal records by anyone he out sources to.

Any organization doing business with Bay Area Credit Services and US Audit Control should be avoided at all costs. Richard B. Hunter, Bay Area Credit Services and US Audit Control should be placed on the watch list for Homeland Security; this man’s GREED is putting too many consumers at risk.

A creditor is not allowed to delete an accurate credit listing, even if it is subsequently paid. It can be shown as paid, but it should not be deleted, unless it should never have been posted.

Why? Are you talking about agreements between the CRA's and the Original Creditor and/or Collection Agency which stipulate accurate entries are not to be removed?
