The Word of ALLAH:
KORAN [2.223] Your wives are a tilth for you, so go into your tilth when you like, and do good beforehand for yourselves, and be careful (of your duty) to Allah, and know that you will meet Him, and give good news to the believers.

KORAN [4.34] Men are the maintainers of women because Allah has made some of them to excel others and because they spend out of their property; the good women are therefore obedient, guarding the unseen as Allah has guarded; and (as to) those on whose part you fear desertion, admonish them, and leave them alone in the sleeping-places and beat them; then if they obey you, do not seek a way against them; surely Allah is High, Great.

HADITH Sahih Bukhari [7:62:67] Narrated Abu Huraira:
The Prophet said, "A matron should not be given in marriage except after consulting her; and a virgin should not be given in marriage except after her permission." The people asked, "O Allah's Apostle! How can we know her permission?" He said, "Her silence (indicates her permission)."

HADITH Sahih Bukhari [5:58:234] Narrated Aisha:
The Prophet engaged me when I was a girl of six (years). We went to Medina and stayed at the home of Bani-al-Harith bin Khazraj. Then I got ill and my hair fell down. Later on my hair grew (again) and my mother, Um Ruman, came to me while I was playing in a swing with some of my girl friends. She called me, and I went to her, not knowing what she wanted to do to me. She caught me by the hand and made me stand at the door of the house. I was breathless then, and when my breathing became Allright, she took some water and rubbed my face and head with it. Then she took me into the house. There in the house I saw some Ansari women who said, "Best wishes and Allah's Blessing and a good luck." Then she entrusted me to them and they prepared me (for the marriage). Unexpectedly Allah's Apostle came to me in the forenoon and my mother handed me over to him, and at that time I was a girl of nine years of age.

HADITH Sahih Bukhari [7:62:64] Narrated 'Aisha:
that the Prophet married her when she was six years old and he consummated his marriage when she was nine years old, and then she remained with him for nine years (i.e., till his death).

Most marriage dissolutions do result in joint custody, but PHYSICAL custody is usually granted to the mother with the father having liberal visitation rights unless there's a reason to alter that situation.

As to all the other points, I'm really not going to get into it, but I'm having trouble figuring out if you believe that consent to marriage equals implied consent to sex whenever one of the parties is in the mood. I don't know where in my post you thought I was stating that "yes means no" unless you were referring to the lack of consensual capacity situations -- in which case the party taking advantage of a drugged, drunk, or mentally limited person's "yes", in my humble opinion, deserves to have the book thrown at them.

I don't think Judaism or Christianity ever countenanced the use of physicial force to compel women (or men for that matter) to have sex with their marital partner. Rather, the Bible and religious teachers have talked about the moral duty of those who join into marriage of satisfying their partners.

Rather than countenancing the use of physical force to compel sex of those who join into marriages, we have - from time to time - tried all kinds of alternatives. For example, the puritans of New England used public embarrassment (the #1 tort in the courts of puritan New England being of wives trying to get their husbands to perform the duty of marriage).

Today, in terms of law, we are at "no fault;" i.e., that either party may leave the marriage for no stated reason. The problem with this approach is the unfairness of divorce in terms of property, support and custody.

(I should point out that a study by the bar, here in Virginia, found divorce to be unfair, but for different reasons for men and for women. Women moreso then men had the problem of finding adequate representation.)

I also tried to point out that, being a free society, the place where we currently find ourselves need not be considered to be an equilibrium place. States, for example, are now routinely denying custodial parents (i.e., mothers) to relocate out of state and, thus, deny the other parent (i.e., the father) a real relationship with the child (albeit visitation).

In one county and then in another, judges are making second custody awards to fathers, when mothers are found to abuse or neglect children. Formerly, here in Virginia, the child was awarded to, e.g., the maternal grandparents rather than to the father.

Some judges are EVEN making initial custody awards to fathers or making initial shared physical custody awards.
