U.S. Supreme Court Justice Anthony Kennedy, a moderate conservative and often decisive vote, was hospitalized for a stent procedure after experiencing mild chest pains, a court spokeswoman said on Tuesday. Spokeswoman Kathy Arberg said Kennedy, 70, underwent "a routine procedure" at Washington Hospital Center on September 2. "This was a revision to a stent procedure performed in November 2005," she said in a brief statement.
Arberg said there was no evidence of any heart damage. She said Kennedy was discharged from the hospital on Sunday morning and had returned to his duties at the court, which is currently in recess.
Kennedy often casts the decisive vote on the nine-member court that is deeply divided with four liberal justices and four conservatives. He has become the key swing vote after the retirement early in the year of Justice Sandra Day O'Connor.

I posted this...did several searches and couldn't find anything on it...glad to see more than I could find. All I did was hear it on local news. We were obviously posting at the same time that must be way the search was useless.
I will have to take your word for it, I always lined him up with the lefties. I was never very impressed with O'Connor, and usually lumped her in with the left also. That way when she did something sensible I would be pleasantly surprised. :O)

If you're not certifiably insane or a complete imbecile, that makes you either conservative or, failing that, moderate conservative.

Kennedy was the 5th vote that stopped the count in Florida. O'Connor did not support Gore's position but did not support stopping the nonsense in Florida. Kennedy is also tends to be a bit sympathetic on issues such as parental consent and partial birth abortion. O'Connor was a huge pro-abortionists. The only case I remember O'Connor to the right of Kennedy was Kelo.

You'd need perhaps 1 cup of cottage cheese, split in 2 to 4 doses per day, or perhaps three times that much yogurt (live culture, not the the usual supermarket yogurts), if even that would be enough.

Well, I don't want to knock the poor guy when he's suffering from bad health, so let's just say that I hope he recovers from the operation and resigns from the court sometime soon.
He is one of Reagan's two biggest mistakes - O'Connor being the other.
He was good at a lot of things, but picking SC judges (one for three) and raising non-adopted children were not two of them.
Having said that...my friend will NOT change her habits at all...yet, her cholesterol is way below what it's ever been in her adult life..with Flaxseed Oil and yogurt once a day in the AM...

For one thing, Kennedy voted to uphold the Nebraska partial-birth abortion ban, while O'Connor cast the deciding vote striking down the law. That's a pretty big difference right there. /p/
And, just looking at 2003-2005, here are some other cases in which O'Connor voted with the liberals to form a majority while Kennedy voted with the conservatives: /p/

O'Connor was the 5th vote and co-authored that horrible opinion in McConnell v. FEC that upheld the McCain-Feingold Campaign Finance "Reform"; Kennedy voted with the dissenters that upheld the First Amendment. /p/
O'Connor was the 5th vote and wrote the opinion upholding the University of Michigan Law School's affirmative action program, thus cementing state-sponsored racial discrimination---Kennedy was one of the dissenters. /p/
So, while Anthony Kennedy os no conservative, he is clearly a more reasonable Justice than Sandra Day O'Connor, and we are far better off with a Supreme Court in which Kennedy is the swing vote than one in which O'Connor is the swing vote. But then again, in case Justice Stevens is reading this, I'd much rather have a Court in which John Roberts is the swing vote. : )

Good question. The answer is that he is a moderate conservative when the libs outnumber the conservatives by 5 to 3. When it's 4 to 4 then he turns lib. You will note that in both cases the libs win. Go figure.
