An atheist mother represented by the ACLU complained that allowing Boy Scouts to recruit in public schools on the same basis as other groups discriminated against her atheist son who attends Portland public schools. In today's decision reversing a lower court decision, the Oregon Supreme Court emphatically concluded that "nothing that occurred in any public school program, service, or activity was discriminatory at all."
"Giving Boy Scouts equal access is not discrimination," said Scouting spokesperson Robert H. Bork, Jr. "It is the law."
"The First Amendment and two federal statues require that Boy Scouts be given the same access to school facilities as other youth or community organizations," said Boy Scouts' attorney George A. Davidson. If the lower court's decision had been upheld, "every school district in Oregon would have been in jeopardy of losing federal funding."

This is a ridiculous lawsuit in the first place. I feel bad for the judges that had to listen to the arguments in this one. It seems to me that it was a "no duh" equal access case, and the Oregon Supreme Court came to the same conclusion. Thank goodness this case was dealt with using common sense.

In theory, he argued, a hate group such as the Ku Klux Klan could make a presentation in an Oregon school about joining, and it would not be discrimination as long as it didn't mention it restricts membership to white people.

Suppose they decided being a black kid was a basis for not being a scout, either. Would they still be allowed to recruit at schools? what does believing in a Sky God have to do with learning to pitch a tent? Is the BSA teaching self-reliance or religion?

In 1871 Bingham's home State of Ohio highest Court considered the question of whether the State had retained the right to establish separate schools for colored children under the Fourteenth Amendment. In the case of Garnes v. McCan, et al. (21 Ohio State Reports) had unanimously decided by a all Republican court that all privileges to a State school system are derived solely from the Constitution and laws of the State. "The privileges or immunities under the Fourteenth Amendment are those recognized by the US Constitution and belonging to US Citizens, and not those privileges or immunities that are the result of a State Constitution and laws belonging to citizens of a State," the court concluded.
"Equality of rights does not involve the necessity of educating white and colored persons in the same school any more than it does of educating children of both sexes in the same school, or that different grades of scholars must be kept in the same school," the court further added. What is important with this decision is the fact Bingham himself considered the courts ruling "just and proper" when later asked by Garfield if he had agreed with the court's interpretation under the new amendment to the Constitution.

It seems pretty clear to me. Maybe they left that part out of the "emanations and penumbra" version.
The ACLU should be prepared for more humiliation at the hands of the trustworthy, loyal, helpful, friendly, courteous, kind, in-your-face, cheerful, thrifty brave, clean and reverent troops.

Times sure have changed. I was actually a Cub Scout back in...well along time ago. I could never imagine being attacked by a band of hateful liberals like the ACLU. This is unreal to me.
But how much did it cost the BSA to defend against this lawsuit?

The problem is, these court battles are incredibly expensive for the BSA to defend. That's money that when spent on lawyers cannot be used for the boys and their programs.

The Boy Scouts teach that self-reliance is dependent upon acknowledgment of human imperfection, and a reverent acceptance of a Higher Power (doesn't matter to us which one you choose) as an example of perfection to emulate.
We call this concept, in a word, humility.
The Scout Oath includes the words "On my honor, I will do my best, to do my duty, to G-d and my country." Taking that oath is part of being a Boy Scout. It doesn't specifically say "what G-d," which is why Boy Scouts were found in nearly every country of the world, generally with the exception of many communist countries.
If you don't want to take that oath, to profess a belief in G-d, you don't have to. In fact, I think that you should form your own "Athiest Scouts," where you don't have to take that oath. In fact you could set up an oath disavowing any belief in G-d for your members.
Nothing, but pitching a tent is a very tiny part of what Boy Scouts teach.

Yes to both, they teach self reliance and Christian mores.
