I agree with you that the left has captured the word "discrimination," with its classic definition you state. However, in the AP article the writer is not using that word in a "discriminating" fashion. Instead, the writer is using it as a shorthand way of saying that the Scouts are prejudiced against homosexuals.

The truth of the matter is that the Scouts are protecting their young boys from potential sexual predators.
