WASHINGTON, Nov. 11 (UPI) -- A battle is shaping up between Democrats and the White House over the Military Commissions Act, signed into law last month by President George W. Bush.

Sen. Patrick Leahy, D-Vt., is expected to take over as chairman of the Senate Judiciary Committee, and The (Calif.) Daily Journal reports that Leahy is drafting a bill to undo portions of the new law in an effort to restore habeas corpus rights for enemy combatants.

(snip)

Spokeswoman Tracy Schmaler told the newspaper the goal is to "try and do something to reverse the damage."

Patrick Leahy is, as usual, dumb as a post about constitutional law. Habeas corpus has NOT been abolished. It is as alive and well as well the US Supreme Court ruled UNANIMOUSLY in 1942 that it existed for the eight German saboteurs convicted of planning bombings, and six were sentenced to death, in the Quirin case.

Habeas corpus was the basis on which the Court reviewed, and then approved, the military tribunals used for those trials. Now that Congress has acted, the same applies to the Gitmo detainees or any other illegal combatants. The regular US courts still have habeas corpus review at the Supreme Court level, but ONLY to make sure that the established procedures of the new military tribunals have been followed, and that's it.

Leahy is either too dumb, or too biased, to realize this. Either way, he is wrong, and any attempt by the new Congress to change the current law on illegal combatants will (or at least should be) blocked by a veto from President Bush.

I think that he should. The American people, through their votes, have indicated that is what they want. They [the terrorists]are only misguided and live in poverty. If we show them that we love them they will stop wanting to kill us.

We have begun the process of showing them how much we love them by getting rid of those evil hate-filled Republicans.

Convert to the religion of peace. Replace all Churches with mosques and all Christian schools with madrasas. Get your women into full length black robes complete with burkahs and death by stoning to all homosexuals and heterosexuals that commit adultery. Chant allah akbahr hundred times a day. Kill all remaining Christians and Jews. See, we can all live together in piece{s}.
