My questions is, where is the check on this self-proclaimed, self-assigned power by the Justice?

At this time, it seems the only check is ...

I think you misunderstood me. The constitution protects our God-given rights - our birthrights, if you will. Once the constitution is undermined, then so are its protections, and thus the state becomes the giver and taker of rights. If you want to consider them privileges once that occurs, that's probably accurate to say, at least in the abstract.

Justice Stephen G. Breyer says the Supreme Court must promote the political rights of minorities and look beyond the Constitution's text when necessary to ensure that "no one gets too powerful."

Sounds like something NORML would support.

The Black makes are 40% UNEMPLOYED. I am sure that a lack of education, skills or training accounts for the most part BUT not all of their unemployment. I do not see them victimized by H1B visas etc either. But a deliberate plan of discrimination, and not necessarily racial discrimination, accounts for a piece of their problem. After all unless you have someone from Barakqzstan or where ever in your firm or G office etc., you are not "Diverse". (Assumes we have one person from Barakqzstan and that person WILL get the job in many areas because of diversity. What ever happened to "E Pluribus Unum"?

Hope that helps.

Black male unemployment has been hopelessly high for decades, long before the Barakastanis invaded.
