Sick, sick, sick, sick. How can we expect our soldiers to fight a war so handicapped? The ROE is a f-cking joke!!! The guys who worked for me in Kuwait knew it. Shoot and be wrong and you go to jail. Don't shoot and be wrong and you die. What kind of war is this???

We expect 25 year old men to make life-and-death decisions and we don't back them up????? My anger knows no bounds. :(

This is a PC war. Our troops balls have been cut off because our gov't has turned PC. Brings back memories when Kerry said in his Campaign, 'a more sensitive war on terror'.

Amen. This enemy is worse than the one in Vietnam. When the enemy resorts to operations in civilian clothing, among civilians, the soldiers have to protect themselves or die.

I'm sorry for the Iraqi civilians, but our guys should not pay the price for illegal and sickening insurgent tactics. I don't even care if they did do it, who are we to say how soldiers should respond when they are attacked and they have to figure out who is trying to kill them? They are also trying to prevent the country from degenerating into a civil war.

Liberals want to pretend that a war looks like a John Wayne movie. Okay, fine, pretend it looks like The Green Berets. There's a nice sequence in there about what happens when the enemy dresses in civilian clothes and infiltrates your position.

ROE are written by JAG types, but with supervison by combat officers.

They do not, because they can not, antipate all situations. The trial will also be by combat types on the Jury, and with JAG officers as Judge.

The Executive pardon function is also both retained and delegated. His commander, or the various JAG proscecutors could have decided not to charge after the investigation. There are political pressures on them, but I am sure the commanders and JAG types each made their recommendation or decision based on what they thought was correct.

We have very good men (and women) in our services. That is also true of the NCOs, Officers, and Commanders. A miscarriage of justice is possible, but unlikely.
