I think what Bush was trying to do with Harriet Miers was to nominate a mere commoner to the SC. That is, someone not from the House of Legal Lords who usually get the nod. Of course he should have done a better job communicating that in advance and people didn't want to take the risk with her.

Funny! I wonder if HM was not nominated to get confirmed, but to say all those things we desperately wish they would say during the hearings. In other words, if she was meant to soften and humiliate the committee.

I agree. In tradition, a President can appoint fresh, unique blood to SCOTUS. Many have. I was open to it, but I wanted the Senate confirmation process to be thorough.

It was a sign of the times that the "conservative intellectual establishment" nuked the appointment. Interesting that they have that clout, and I don't necessarily fault them for taking that stance, given the state of the jurisprudential "war".

I delved pretty deeply into her background at the time Bush nominated her. She is, basically, a very skilled team player who excells at working with the Establishment, whatever that happens to consist of. She coordinated and managed a big-time team of lawyers who appear to have done mostly political type jobs, also working for the establishment.

Miers has some negatives. She is a professed feminist, and she has spoken out strongly in favor of affirmative action. She also, despite being an Evangelical, cannot be trusted on right-to-life issues.

But while she was working for Bush, she appears to have done her job very well, coordinating the search for candidates and into their background, and coming up with a good list of names. In a way, it wasn't her fault that she herself was nominated. She is socially skilled, and has a personal relationship with W and Laura. She has often dined with them. The initiative to appoint her appears to have been backed by Andy Card, who was too liberal for the post he held, and by Laura herself, who revealed herself to be a feminist during the Miers mess, notably by her accusation on a TV talk show that anyone who opposed Miers was a woman hater.

Normally Laura doesn't get involved in politics, so these beliefs don't matter, but Bush incautiously let her advice him about Miers. Big mistake.

Anyway, I would imagine that she leaves behind her a list of vetted candidates, ready to go any time an opening appears. I wouldn't read too much into this. She was a big money maker in Texas, and she probably wants to get back to work. Let's just hope and pray that Bush selects someone really competent to take her place, someone with the right ideas about what kind of judges we need. Not another Andy Card, please.

Sorry, this is the same GW whose "compassionate conservatism" gave us the biggest expansion of federal entitlements in history, plus a massive federal intrusion into public education. He's exhausted his benefit of the doubt, and I'm not going to accept a complete unknown solely on the basis of his voucher.

Miers was a terrible pick, and I'm very glad she got the boot. I only wish Bush had nominated Alex Kozinski, but I don't suppose that's very likely.

It won't matter now anyway. What kind of judges do you think will get through Congress now? We'll have the type of judges Reagan was forced to nominate (O'Conner, Kennedy).

I'm thinking Janice Rogers Brown.

To do her credit, her team came up with two fine candidates, although I suspect they may have filtered out a few others whom I would like to see move forward. That's hard to say.

Brown would be the perfect candidate. Let the Dems try to destroy a very likeable black woman as we approach the 2008 election.

To give him credit, except for the Miers fiasco Bush has not nominated a lot of compromise candidates. It's one of the areas where he has pretty well kept his word to his base.

I agree the situation is far more difficult now. But it could still conceivably be done, because the Dems really fear coming out in the open on some of these issues before a national audience. They won the last election mostly by pretending to put up "conservative" candidates like Webb. They're not conservative, but they pretended to be.
