FBI probes fatal Ariz. border shooting

PHOENIX - The FBI said Monday it was investigating the shooting death of a Mexican immigrant by a U.S. Border Patrol agent that had been criticized by Mexican President Felipe Calderon.

Francisco Javier Dominguez-Rivera, 22, of Puebla, Mexico, was killed Friday in a confrontation with the unidentified agent north of the U.S.-Mexico border between Bisbee and Douglas.

On Sunday, Calderon expressed his "most energetic protest" against the shooting.

A group of seven people were crossing the desert and the agent took six of them into custody without incident, authorities said.

But the agent and Dominguez-Rivera began fighting, authorities said. The agent, who believed his life was in danger, shot and killed the man, the Border Patrol said previously. An autopsy was scheduled Wednesday.

The agent was put on paid administrative leave pending the investigation.

FBI spokeswoman Deborah McCarley and Gustavo Soto, a spokesman with the U.S. Border Patrol Tucson sector, both declined Monday to provide details of the case.

The border war kind of reminds me of Viet Nam when LBJ and McNamara had one arm tied behind the back of our military.

It is absolutely incredible IMO of how GWB can allow this kind of thing to happen that border patrol agents can be prosecuted.

What would happen if a group of Guatemalans illegally crossed the border with Mexico and begin fighting with the Mexican border patrol?

Hey Felipie, if you don't want you people shot, try telling them to cross at legal border crossings, weight their turn and don't fight with our border guards. Is that so hard to understand?

Why in God's name would anyone be a border agent when you are investigated and thrown in jail for doing your job?

I'm getting sick and tired of an administration that won't back up its own forces. As for the FBI, I wouldn't trust them any farther than I could kick them in an investigation like this.

They won't allow the National Guard to defend themselves, and they jail any immigration officials who try to do their job. Even if they don't care about protecting their own people, this is no way to score points with their base.

This is not an immigrant. This is, was, a foreign national illegally entering our country from Mexico. Interesting how we Americans citizens now must show passports to get back into our own country while illegals need nothing.

Yeah, well kiss my muscular ass. I protest the hundreds, thousands of murders, rapes, molestations, aggravated robberies that are perpetrated on US citizens by Mexican nationals illegally in the USA!!

Looks like our government is sending them a message. If Border Agents are union, they should walk off the job in protest.

Nevermind the American people's "most energetic protest" about these people coming here illegaly.

Yoo hoo, Mr. Calderon! Tell your people to stay home and they won't risk being killed by people who are doing exactly what they were hired to do.

The Bush policy; We can and will protect and secure the borders of Iraq and Afghanistan! But when it comes to the borders he has sworn to protect and defend, it seems to be, "So what's a few million illegal invaders, as long as the all talk mexican."

The longer this invasion of our borders goes on and the President ignores it, the more I pray the d's will impeach him.

This is appalling. If our own government is going to hound and persecute Border Agents forced to protect themselves from violent border crossers, we might as well open the gates and look the other way. Bush is guilty of dereliction of duty for caving to Mexican pressure and prosecuting our Border Patrol Officers.

So are you saying that nobody should look into this killing by a law enforcement officer??? Would you expand this blanket immunity to other law enforcement officers??? Should the next shooting by your local sheriff just be swept under the rug?? I'd rather not go down the road where lethal force is used with complete impunity. Regardless of who is killed. And I'm no big fan of illegal immigration, I'd just like us to stay on the civilized side of the abyss. Some of the blood-thirsty responses I read on here amaze me, why don't we just bring back the gladiators and throw the damn Mexicans to them or the lions??? What I'd rather see is a 30' concrete wall and controlled immigration.

Unfortunately, the government's recent past isn't good.

Bush's Department of Justice, brought an admitted Mexican drug smuggler, who had been wounded by BP agents to the U.S. to testify.. In order to get him to testify against the BP agents, they offered him immunity against drug smuggling charges not once, but twice. He was caught bringing a second load of drugs into the country after testifying.

Patrolling the border is a tough job. The agents face
mortal danger every day. Accidents happen.

By the way, the drug smuggler is now suing the U.S. government for violating his civil rights.

I've read the news releases from both sides of the Ramos/Compean incident and if it's true that these two fired 15 rounds at an un-armed man who had surrendered and put up his hands, well then I say they got off light with only a 11 and 12 year sentences. I also read that they were offered a plea deal that would have them only doing 18 months and they turned it down. Having a tough job does not entitle you to "007" license to kill powers. One shot is an accident, emptying a clip is not an accident.

I couldn't care less why this criminal was shot. Had he not broken our laws and contributed to a problem that's destroying our nation he wouldn't be dead now. I won't shed any tear for any illegal who dies on U.S. soil no matter what. If you're not on our soil you won't die on it. Illegal immigration is completely out of control and it's ruining this nation. There will be a major conflict in the the future and everyone who ignored the problem or supported open borders can take responsibility for the violence.

I would when it involves an illegal. I'm at the point that I don't care what happens to them when they are over here. These problems could be avoided if the criminals stayed in their own nations and didn't invade our country and break our laws.
