The United Nations' highest court has ruled that although the 1995 Srebrenica massacre constituted genocide, Serbia was not responsible for it. However, the court did conclude that Serbia had failed to stop the killings from going ahead.
Court president Rosalyn Higgins said: "It must therefore be concluded that the organs of the respondent did nothing to prevent the Srebenica massacres."
The ruling by the International Court of Justice concludes a case brought by Bosnia against Serbia on whether Serbia was guilty of genocide during the 1992-95 Balkans war. Judge Higgins added that the court was not convinced that in other mass killings of Bosnian Muslims the perpetrators had the specific intent to commit genocide.
During the Srebrenica massacre in July 1995, some 8,000 Bosnian Muslim men and boys were shot dead by Serbian troops and buried in mass graves in what was supposed to be a UN safe-haven. It is is the first time a state has been on trial for genocide, which was outlawed in 1948.
I don't respect the court that ruled this.
"Serbia cleared of genocide but not Srebrenica"
Serbia was guilty of failing to prevent the genocide of some 8,000 Bosnian Muslims at Srebrenica in 1995, the UN's highest court ruled today.
But the international court of justice cleared Serbia of direct responsibility for genocide and complicity in genocide in Bosnia, in the 1992-1995 war.
The decision took the form of several votes. In the key verdict, the court decided by 13 votes to two, that Serbia had "not committed genocide, through its organs or persons whose acts engage its responsibility under customary international law". In another vote, however, the court found by 12 votes to three, that Serbia had "violated the obligation to prevent genocide".
Clinton told the American people that it was 250,000 in mass graves. Oh well, his lies are okay.
Out of 8,000 comabatants (not "boys") only 1,200 are confirmed to be found burried in region of Srebrenica, and out of that "8,000" only 400 were identified as someone connected to Srebrenica. Most of 1,200 bodies hade sharapnel wounds and were killed in combat.
Allmost 90% of Srebrenica "victimes" are dugged-out all around Bosnia and instantly labeled as "Srebrenica victimes".

Pay attention to the word "Serbian" implying that the trops belonged to Serbia. They did not. The troops were Bosnian Serbs.

As of last July, over 2,600 Srebrenica related victims had been identified from those recovered from mass graves which litter the Republika Srpska's territory, and the mass graves are still being exhumed to this day, with 1,153 bodies being exhumed from a Srebrenica related mass grave near Zvornik last year, and further sites slated to be excavated this year.
Further, featuring prominently in the testimony of forensic scientists who were called during Srebrenica related trials at the ICTY are words like "ligatures", and "blindfolds", which give the lie to your assertion regarding battle-related deaths. The Serbs were too lazy and unconcerned to police up bodies from the battlefield, and populated their mass graves with folks who could be herded to their execution sites and then dispatched by bullet.
Immediately after Srebrenica, lies like yours may have sufficed. But in the ensuing decade, the veil of deceit generated by those like you to try and deny the slaughter and obscure the subsequent "hide the bodies" campaign has been pierced and shredded.

The court told the truth. The Clinton Administration and ICTY was a set up. The Clinton Admin. specifically claimed on CNN and news that 100,000 K-Albanians were missing feared massacred....then, oppps, no, maybe 10,000, ....oppps, well, we don't know why we found only about 1,208 bodies.....and some of those were Serbs. There were no rape camps, no massacres, and no 8,000 massacred Muslms in Srebrenica. Maybe about 3,500 or so, but they were combatants.....the rest of the 4,000 went to Kosovo, and other areas of conflict to stir up more trouble as We....U.S. Govt. protected the Mafia and KLA criminals....I know this because I lived there for five years (1999-2004), I'm American and worked closely with the military and security.

It's just that in light of evidence recovered from the mass grave itself, your contention regarding that particular gravesite being filled with victims of local combat is no more than stupid fantasy. Those victims were prisoners who were executed, buried, and then removed from their initial resting place and reburied at the gravesite at Kamenica.

Later, in blazing sunshine, Muslims and Serbs sat down in the middle of the road to hammer out a peace deal. The Serbs offered Srebrenica's Muslims autonomy within the Bosnian Serb republic, but that was rejected. Since then the war in eastern Bosnia has seen the most vicious fighting in the benighted republic...

The Second Surrender of Srebrenica

BELGRADE, SARAJEVO, BANJA LUKA -- The ICJ judgement triggered reactions from both Sarajevo and Belgrade. Bosniaks disappointed, Serbs satisfied.
In reaction to today's judgment, Serbian President Boris Tadiæ said the ICJs ruling was "immensely important to Serbia and its citizens for proving that Serbia did not commit genocide in Bosnia".
However, the part of the ruling pertaining to Serbias failure to do what was in its power and prevent the genocide over Bosniak citizens in Srebrenica is hard on Serbia, Tadiæ said in his direct address to the public.
The part of the judgment that demanded Serbias immediate and full cooperation with the Hague was particularly important to Serbia, according to Tadiæ.
Should Serbia fall short of complying with the Courts ruling, it will suffer serious political and economic consequences, Tadiæ concluded.
Meanwhile, Serbian prime minister Vojislav Kotunica said the only way toward the necessary reconciliation between the former Yugoslav nations was in solving all the war crimes and bringing their perpetrators to justice.
The ICJ judgment in Bosnian lawsuit against FRY is particularly important as it clears Serbia of the heavy accusation of genocide, Kotunica said in a statement.
He added Serbia was undertaking and will continue to undertake all the necessary measures leading to the full Hague cooperation.
It is in Serbias interest to finalize that cooperation as soon as possible, Kotunica said.
Sakib Softiæ, Bosnia's representative in the case against SCG, is only partially satisfied with the ICJs ruling. He said he was content that the International Court of Justice found Serbia accountable for failing to stop the genocide in Bosnia, arrest war crimes fugitive Ratko Mladiæ and falling short of punishing the perpetrators of genocides in Bosnia, Nes radio reports.
However, he expressed his disappointment that the Court didnt find FRY itself responsible for the genocide.
Bosniak member of the Bosnian Presidency Haris Silajdiè said he was unsatisfied that Serbia and Montenegro escaped responsibility for, and complicity in, genocide during the 1992-95 Bosnia war.
On the other hand, this the first time a state has been accused of breaching the 1948 Genocide Convention by failing to prevent and punish the perpetrators. Serbia thus has to assume its political, moral and material accountability for the act, Silajdiæ claims.
He added that the ruling was inconclusive.
Bosnia-Herzegovina thus needs to annul the results of the genocide that permeate all stratums of Bosnian society. We will achieve that by altering what has been founded on the genocides outcome interior structure of Bosnia and its Constitution", Silajdiæ concluded.
Bosnian Presidency member eljko Komiæ said he was disappointed with the International Courts ruling in the case of Bosnia against FRY.
I cant say whether the lack of evidence or the wrong judgment has been at work. The genocide was committed in Bosnia in the Nineties and anyone who thinks otherwise shuts his eyes before the truth. I know what I will teach my children, Komiæ said adding that Bosnia was now obliged to abide by the ruling which wouldnt bring harm to mutual relations of Bosnia and Serbia.
Republic of Srpska satisfied, but worried
The Republic of Srpska breathed a sigh of relief at todays ruling, but wondered whether its content in effect shifted the responsibility from Serbia to the Republic of Srpska.
A legal expert from Banja Luka, Miroslav Mike, said that Serbia "acted as it did",a s well as that "Serbias attitude cannot have repercussions for the Republic of Srpska".
Bosnian Presidency Chairman Neboja Radmanoviæ said he hoped that the ruling wouldn't strain the situation in the country, and worsen relations between Bosnia and Serbia.
The ruling is bound to disappoint Bosniaks and add to the tensions. I cannot say at the moment what could change in Bosnias relations with Serbia. The Bosnian Presidency opted to nurture good relations with its neighbors and we will make sure that the whole country follow suit, Radmanoviæ concluded.
Dodik against collective guilt
Milorad Dodik, Prime Minister of the Republic of Srpska, underlined that atrocities in Srebrenica cannot be labeled as genocidal but regarded as a crime.
He rejected any responsibility on the part of the Republic of Srpska, its institutions and the Serbian people in general.
I eliminate RSs responsibility and oppose the attributes attached to the crimes in Srebrenica. It was not a genocide, and whatever happened there had not been planned, Dodik told the press adding that he still believed the indictment to be illegal and illegitimate from the start since it hadnt been launched by official Bosnian institutions.
Dodik insisted that all attention must from now on be focused on the dialogue aimed at Bosnias prosperity.
Drakoviæ: Serbia to punish perpetrators
Serbian Foreign Minister Vuk Drakoviæ believes that Serbia can be satisfied with todays judgment since there will no longer be any stigma attached to its alleged liability for Srebrenica genocide.
Serbia is morally responsible to bring the real perpetrators to justice, Drakoviæ said underscoring the importance of the "proven" truth that Serbia was not to blame for encouraging or instigating Serbrenica massacre.
League of Vojvodina Social-Democrats leader Nenad Èanak said he was speechless as he learned about todays judgment in Bosnian genocide suit against Serbia.
Let the blood and ashes of Bosnia fall on the hands of all those who reached such a verdict, Èanak was quoted.
They should be giving the Serbs medals.
I've been to Sreb a few times where the only use of armored vehicles is north of Srebrinica for any off road use. Anywhere else would have to remain on the hardball.

Yep, that's a good clear map. At Kamenica, the Muslims admitted they lost up to 2,000 men in very very one sided ambushes.
A year or so later, and a Finnish team made a quick search of the area and discovered over 600 dead Muslims who'd fallen in this turkey shoot. Many had hung themselves rather than surrender, many had killed themselves and others in mass suicide, machine gunning their comrades down, many had started to fight amongst themselves, many had fallen victim to merciless and accurate Serb artillery fire, fire from point blank range by Serb AA Praga canon fire, VRS infiltrating the column and using knives and garottews to slay their enemy.
The VRS talk of over 2,000 ABiH being killed in this one area.
So, no surprise that some mass graves have been found there.
