Prosecutor Drops Charges in Duke Case

It would seem that not only do the 3 students have a claim on Duke, but that the coach of the lacrosse team would have a claim on a portion of Duke. Not a good time to be either the AD or president of Duke

I hope that the three young men in this case file civil charges against Nifong, Jackson, their female accuser, the Duke professors, Duke University, and the DNA lab.

In addition I hope the entire Duke Lacross team sues Duke university for the ruined season last year and the fired lacross coach files his own civil suit.

In the rush to judgment the university, Rev Jackson (I really would like to know what church he pastors), and Mr Nifong have done such terrible damage to the reputations of all the players and the coach of this team that they may never realize their true potential.

Welcome to the legal system for many poor and working class people. Both black and white. Across America. Most cases end up with a plea bargain to lesser charges. Simply because the accused doesn’t have access to high priced legal help. The prosecutors play a numbers game. Racking up convictions to pad their resume or justify their budgets.

If I didn't despise them so much, it would be interesting to see Nancy Grace and Wendy Murphy have a melt down tonight over this.

I still remember how Nancy Grace said that if the guys were innocent then why didn't they have an alibi? The next day one produced an ATM receipt and then she said that it was "awfully convenient" and further proved their guilt.

Unfortunately, Nifong is most likely protected from civil action. Hopefully he will be disbarred though.

It would be interesting to see if the NC Democratic Party had anything to do with the continued prosecution of the students? Did the NCDP encourage this activity to win the black vote?

I’m not sure they would have much of a claim against Duke. They were indicted on charges of rape, kidnapping and sexual offense. I’m guessing that Duke had a right (and probably a responsibility to the other students) to temporarily suspend students charged with felonies from campus. In this case the charges were shown to be false, but I imagine there would be a lot of enraged parents if someone facing those types of charges was living down the hallway from their daughter. Would you want your child rooming with someone indicted on murder charges, but not yet proven guilty?

Add Fox’s Lis Wiehl to the list. She was ready to lynch those guys from day one. Greta, on the other hand, seems to have gotten suspicious of Nifong early on.

Not even close. I don't think they have to go far beyond the libel and slander charges to get at Duke. Duke would have been OK if all they had done was suspend, but those idiot left-wingers on the faculty had to prove their liberal womenhood and go after them.

The university and the Duke 88 are two separate issues. The Concerned Faculty at Duke placed the ad in an independent newspaper, not the University.

Not in my experience. Prosecutors offer plea bargains because they usually can get a decent plea from guilty defendants without the time consumed by a jury trial. Defendants take plea bargains because they know they're guilty and the bargain is better than they would get if they went to trial and were found guilty. "High priced legal help" usually try to get the best plea bargain they can for their clients, most of their cases do not go to trial. Prosecutors I know are way to busy to be playing games. Most of the "prosecutor" problems in the news are caused by political appointees or elected officials. Most of these "prosecutors" rarely handle cases or go to trial themselves.

The university is not responsible for the speech of its employees in a forum that has no ties to the university. If you were to place an ad in a newspaper that defames another person, why should we be able to go after your employer for damages?

"Had offered?" -- ROFL! -- so it appears the "scholarship" offer by Jesse Jackass is no longer on the table since they weren't "able to contact her!"

No doubt Jesse would still like to personally "minister" to her if he ever gets the chance!

In ordinary cases yes, but in this case "The Concerned Faculty at Duke" that placed the ad are now representing the university by invoking its name to use as cloat for their words. They will have a tough time in court trying to convince a jury that a group of faculty members from 1 university, calling themselves "Concerned Faculty at Duke" are not to be associated with the university, especially after the hell they and the university put the boys through.
