State sues S.B. County over global warming

Ryan Orr

April 13, 2007 - 11:04PM

SAN BERNARDINO — Attorney General Edmund G. Brown Jr. filed a lawsuit Friday against the county of San Bernardino’s recently-updated general plan because it did not properly address global warming.

The lawsuit came just two days after a similar lawsuit was filed by the Center for Biological Diversity, the San Bernardino Audubon Society and the Sierra Club.

Brown filed the lawsuit under the California Environmental Quality Act on the basis that San Bernardino County failed to evaluate and disclose the impending impacts of the plan on climate change and air quality.

“This is a tremendously important action by the attorney general,” said Adam Keats, attorney for the Center for Biological Diversity.

First District Supervisor Brad Mitzelfelt questioned the value of the state suing the county.

“If this is true, I would suggest that the state of California should be helping local governments build infrastructure and protect citizens from crime instead of suing us over what is at best a federal environmental issue,” Mitzelfelt said Friday. “In my opinion the attorney general’s comments were adequately addressed in the General Plan update.”

During the plan’s development, the attorney general along with the conservation groups had submitted comments that urged the county to analyze greenhouse gases and climate change in its blueprint for the future.

According to a press release sent out by the Center for Biological Diversity, the county chose to ignore the comments.

Mike Zischke, an attorney that specializes in the Environmental Quality Act and is working with county counsel, said the county’s position is solid and they will defend the General Plan.

I think this is GREAT! They are starting to eat their own. Maybe they will p*ss off the Kali voters enough to cause people to see where this global warming stuff is really going.....loss of freedom and socialism.

Plus it's about time someplace other than Ohio was sued for pollution and global warming.

Yeah well... El Dorado County had Jim Moose (what was the big flap his daughter was involved with a few months ago? It was all over the Sacremenna BEE when daddy Moose came to her defense) of Remy, Thomas & Moose "bullet proof" it's plan in 1996 to no avail. That little black liberal woman judge in Sacramento "Superior" court tied it all up for almost another stupid decade!!!

G.D. I hate these liberal dip-sticks!!! (well... almost hate)(they're really not worth hating)(but boy it sure is tempting)

I find it interesting how “urged the county” has morfed into “threatened the county”.

AKA Democrats have made real estate investments and want the power to call the shots about where people get to build so that their contributors can cash in on the shortages.

Now, look at the graph and guess why Arnold is big on glow-bill warming.

Maybe some day the RINOs who supported this crooked grovelnator will figure out why he went left.

“This is a tremendously important action by the attorney general,” said Adam Keats, attorney for the Center for Biological Diversity.

It certainly is, but not for the reasons this doofus would list, were you to ask him.
In spite of the historically recent abuse of the word, this is fascism in its classic form (look it up).
Even if global warming could be blamed totally or primarily to human activity (which it hasn't), this heavy-handed move by government is arbitrary and illegal, no matter what special-interest groups are driving it.

This is a clear abuse of authority. All environmental laws from the beginning were never intended to halt human activity entirely. The intent was to make sure that all impacts were identified and considered when a large proposed project directly affects adjacent areas.

All these "environmental" laws were promoted and passed with the understanding that the final decision to proceed with the project was entirely the agency administratively responsible for its approval, regardless of the impacts identified. That this has been perverted into a means of forbidding all future human activity is the unexpected consequence and contrary to every reasonable discussion prior to 1972.

I'm beginning to think that physical conflict will remain the only option to reverse this absurd administrative trend, and what is fundamentally a political war with physical dire consequences.

I didn't; the article did. Here is what the article says, in the quote I put in the post that you read:

“During the plan’s development, the attorney general along with the conservation groups had submitted comments that urged the county to analyze greenhouse gases and climate change in its blueprint for the future. “

Now, just what is a county's "blueprint for the future" if it isn't the General Plan controlling future development?

There are more Republicans in California than in any other state in the Union. Bush and Cheney received more votes from California in 2004 than any other state state -- a million more than the next state, Texas.

And perhaps we need to formally announce our complete succession from Norte Mexico and declare our annexation back into the United States once again. Norte Mexico is located along the left coast from Los Angeles up through San Francisco. Obviously Norte Mexico (flush with Mexican Drug Cartel Money) is now using the courts to sue the nearby lands it has yet to conquer.

Oh ... now socialists are NOT those who take money from the rich to give to the poor - Socialists are those who use political power for capitalistic motives.

So a polititian who campaigns on creating a busness climate conducive to growth and prosperity, and who receives donations from businessmen based on his stated goals is a socialist. Interesting take ...

Problem: Population.

Solution. End illegal immigration.

Chances. Zilch.

What is going to happen when California runs out of water?

There has not been a new dam built in over 40 years. Our reservoir supply is the same now (at 30 million) as when we were 22 million.

We have a water problem, folks. Time to check the clock.

Well duh - Southern California is basically a desert - without having devised solutions of the years, like LA buying up Owens Valley, the daming of the Colorado, and now the debate over the lining of the All-American canal, we would have run out of water in San Diego decades ago.

When water becomes too expensive to get for use here, do you expect the population to sit around and die of thirst ?

Fascism is an authoritarian political ideology (generally tied to a mass movement) that considers individual and other societal interests inferior to the needs of the state,

This is precisely what you advocated. The "needs of the state" being the "investment" you call "capitalism." Leftists differ only in deeming that "investment" to be welfare of various sorts. In either case, it's government taking the money and deciding which "investment" is more beneficial to the people in power, the government itself.

Glad to clarify it for you.

Enriching political supporters through legislation "so that their contributors can cash in ( as you put it ) " would not be Fascism.

Sure it would. The STATE confiscates the money. The STATE determines which supporters get the money. The STATE does that to perpetuate the power of those in control of THE STATE.

Love the way you toss out the meaningless phrase "does not optimize..." as if the government EVER optimises anything... LOL

Which is why the fascist political corruption with which you are so enomoured is destructive to wealth and is in no way "capitalist."

LOL You first say that Democrat supporters of Arnold are somehow going to “cash in” - now that has somehow morfed into the “state” collecting that income for it’s own uses.

Let me remind you what you said - “.. Democrats have made real estate investments and want the power to call the shots about where people get to build so that their contributors can cash in on the shortages. “

Acording to Carry_Okie it is the contributors who do the “cashing in”, not the state, and that “cashing in” would NOT come from state coffers. It has to come from willing buyers in the private sector who feel it is worth the money.

Further, any such “cashing in” would presume that the buyer is NOT part of the party, otherwise there is no effective gain. ( transfer of land from brother to brother does not give a family an increase )
