PHOENIX - A Border Patrol agent was charged Monday with first-degree murder in the shooting of an illegal immigrant at the border in January.
An investigation found that Agent Nicholas Corbett's killing of Francisco Dominguez-Rivera, of Puebla, Mexico, was not legally justified, said Cochise County prosecutor Ed Rheinheimer.
Corbett is also charged with second-degree murder, manslaughter and negligent homicide.
Corbett's attorney, Daniel Santander, didn't immediately return a message left Monday afternoon by The Associated Press.
The shooting, which drew condemnation from the Mexican government, occurred while Corbett was trying to apprehend Dominguez-Rivera and three others who were trying to enter the country illegally.

There’s a problem here and clear thinking people better start demanding the government cut the bullshit once and for all and come up with some real answers. We put law enforcement on our border for a specific purpose and then the government un-officially tells illegals to keep crossing the border it’s ok with them. Then when a situation like this one happens the Border Agent goes to prison,maybe for life.If I was a Border Agent I’d run as far and as fast as I could when I saw illegals crossing the border because no question these guys are in a lose-lose situation !!!

This is crazy, the decision to prosecute is based on a video from a camera
TWO MILES AWAY and since the DA can't see the agent being threatened with a rock they decide to file charges.
What the hell is going on that we are sending people to protect the border and when they do we send them to prison??? This has got to stop. If they want to impeach Bush, this is the reason to do it.

A U.S. Border Patrol agent's account of what led him to shoot and kill an unarmed illegal entrant in January doesn't match witness testimony or forensic evidence, records released Monday by the Cochise County Attorney's office show.
The documents appear to support the claims of witnesses, including family members of Francisco Javier Dominguez-Rivera, 22, of Puebla, Mexico, who have said the agent already had a gun in his right hand when he drove up to them in a Border Patrol vehicle the afternoon of Jan. 12 about 150 yards north of the border between Bisbee and Douglas. The area is southeast of the Paul Spur Lime plant and Arizona 80 and is routinely used for smuggling of both people and drugs.
The witnesses said the agent ordered them to the ground and had switched the gun from his right to left hand as he physically pushed Dominguez-Rivera, to the ground. That is when they said the gun fired.
The agent, Nicholas Corbett, has not cooperated with investigators. However, he reportedly told colleagues on the day of the shooting that he was in pursuit of three members of a larger group of illegal border crossers and had moved to intercept them in his vehicle. He exited the vehicle with his gun drawn and spotted a man at the rear of his vehicle with a rock in his hand.
When the man made a motion as if he were about to throw the rock, Corbett said he raised his weapon and fired a single round.
The bullet that killed Dominguez-Rivera entered the left side of his chest, passed through his heart and liver and exited the abdomen a couple of inches to the right of Dominguez-Rivera's navel, according to an autopsy report by the Cochise County medical examiner's office that was released along with hundreds of other pages of documents related to the shooting investigation.
Cochise County Attorney Ed Rheinheimer said he has not yet decided whether the agent will face charges, noting that that decision will not be made until he's had a chance to review a video of the incident captured by a Border Patrol surveillance camera.
That videotape is in the hands of the FBI, he said, where it is undergoing "video enhancement."
Corbett has returned to active duty since the incident, Border Patrol officials said.
Then here is another story from just a few days ago of another BP Agent shooting to death another illegal last month... It has a video with it that apparently shows the illegal attempting to throw a rock at the agent.....

Ever since murder was a crime under state laws. Couple that with the fact that the Policy of the Border Patrol is to run and hide, the agents have no protection.
I think the Federal government has to make it clear that illegally entering the country and refusing to surrender when caught may result in a dirt nap.

It seems that this country is being run by the Mexican Government. They complain and a Border patrol Agent has to be nailed to the cross.
They couldnt give me that job for twice what they pay and if I took it they would find me asleep in a patrol car somewhere. I wouldnt get anywhere near any place where I might possibly come across an illegal. This is one job where you cant win.

The government sure is going after the BP agents. If they do their job, they can be assured of getting charged with crimes that carry long prison terms even if the government has to manufacture the evidence. The message - give safe passage to drug dealers, terrorists and other scum. And yes, these criminals then also get rewarded with huge sums through lawsuits or confiscation of property of legal Americans. What a sick nation we have become.

Folks, this one may be an actual bad apple.
Border Patrol video and the coroner’s forensic evidence indicate that this was not a good shoot. The agent changed his original story to match the evidence at the scene.
Johnny Sutton is not on this case.
