Sebelius, Kansas and the Second Amendment

Democrat Kansas governor Kathleen Sebelius has attacked the Bush administration over the availability of Kansas National Guard equipment to deal with the current tornado damage in that state. Sebelius told the Associated Press that the rebuilding effort in tornado-ravaged Greensburg, Kansas, likely will be hampered because some much-needed equipment is in Iraq.

Sebelius, the current chairwoman of the Democratic Governors Association, took office on January 15, 2003.

My question to Governor Sebelius is this:

Since you are a Democrat, undoubtedly you favor the "collective right" view of the Second Amendment of the Bill of Rights. Your support of Kansas state gun control measures, and various vetoes of pro-individual right Kansas state legislation show this to be true.

In the "collective right" theory, the Second Amendment exists to protect the State militias (the State National Guards) from the federal government.

So,Governor Sebelius - why didn't you immediately sue the arrogant, usurping Bush administration on Second Amendment grounds when you realized several years ago that the federal government had appropriated the Kansas State National Guard?

Or perhaps you didn't realize it till just now, which means that you're not doing your job, and should be relieved of command by an immediate referendum of the Kansas voters?

Or perhaps this is just a vicious political stunt by a partisan Democrat hack?

Sorry, but this has already been done back in the 1980’s and it is already setteled law. Back when Reagan was conducting operations in Central America, many NG units were deployed there to build roads and other infrastructure. The liberals were extremely upset that we were trying to cause difficulties for the communists there. One govenor, Michale Dukakis, sued the federal government saying that the Mass. NG were under state control and could not be deployed outside the state without the goveneror’s approval. USSC ruled that the federal government exercised plenary power over the NG. (Plenary means roughly absolute.) In effect, the federal government owns the NG and can do any thing with them they choose whether the governor agrees or not. (I believe this case was Dukakis v. Rumsfeld.)

Now, the interesting thing about this case is that it drives a stake into most collective interpretations of the 2nd Amendment. In effect, the founders saw the militia as independent from the federal government. Now, how can one argue that the NG is the current version of the militia, if it is not independent from the federal government?

This is so much BS. With the help of many volunteers with their own equipment, Holly, CO hauled 1,000 (yes one thousand) loads of rubble to their local dump in 4 days during their initial cleanup. There were no troops in town, their help was turned down as not needed. There were many sheriffs deputies and a couple of state patrol cars in town. The patrol helped with traffic control because of the heavy traffic. The state highway dept. put up large lighted traffic info boards at each end of town to ask the through traffic to slow down because of the heavy cleanup traffic. It worked and it would here if the paper rattlers would just get out of the way.

Yes, I know that this is on a larger scale but figure out where the rubble needs to go and let em get er done!

Oh, great, DD - you just rained all over Sebelius' and the AP's HateBush parade.

So, the Founders were worried about the Federal Government taking its guns away from itself, then? I imagine that question kept Washington, Madison and Jefferson up for many sleepless nights... ;-)

Sebelius is not the brightest bulb in the socket.

Kansas voters have gotten what they voted for just the same as the people of Louisiana.

Democrats govern on emotion and feel good policies thereby often overlooking disaster staring them in the face.

I believe Billy Boy Clinton and his Madam Hellary did the same and gave us 9-11.

I had visions of Louisiana-North. The location has changed, the causative factor of the damage has slightly changed, but the bleat is the same - we can’t help ourselves because ,,,,. In that refrain Bush and Iraq will appear. Perhaps in a day or so FEMA will also catch some blame.

My question is what is the function of the state Governor to sit back an wait for the Federal government to act?

Kathy needs to answer the following questions before I think she can even begin to whine:
1. How many national guard’s men and how much of the available equipment of the guard is currently in Greenburg? (I have NG friends and no one has called them up as of Monday morning, perhaps they were just overlooked.)
2. When Omaha was devastated by a tornado, the governor had the Guard come, but he also asked for help from the Army Reserve, who sent men/women and equipment to help. Has Kathy asked the Reserves for help?
3. If all the Guard left in Kansas and their equipment and the help of the Reserves and the volunteer help of civilians from all over Kansas is not enough, just how much more help does she need. I’ve got a pick up truck and a chain saw and will be glad to go if I’m needed. I have not heard that she has thus appealed for help.

FedGov response to disaster is spelled out in great detail in The Stafford Act. FedGov can do nothing without written requests from the state’s governor, and the governor must grant authority for anything federal like FEMA or NG.

I advise all FReepers to look it up and start publicizing Stafford, the MSM hate machine relies on the sheeple’s ignorance in this field.

It was passed in the 80’s and may be due to Dukakis’ lawsuit mentioned above.

MM, looks like they're going to try it again even though President Bush didn't take the bait during Katrina.

Of course, if they can't impeach him for breaking the law, they can accuse him of cold indifference because he wouldn't break the law and the DNC media will cover for the idiot governor.

Maybe Sebelius should talk to the folks in Xenia, Ohio to see how they handled the outbreak of 1974

April 3, 1974: Xenia Tornado
The tornado superoutbreak of April 3-4, 1974 resulted in 148 tornadoes in 13 states. Across the United States, 315 people were killed, more than 6,000 injured, and 27,000 families suffered property losses. The Xenia Tornado caused the most deaths of any tornado in the outbreak. In Ohio, 12 tornadoes touched down, killing 36 people.
The Xenia Tornado touched down at 4:30 PM nine miles southwest of Xenia and entered the city about ten minutes later. It continued northeastward on a path of 32 miles through Xenia and Wilberforce into Clark County. The Xenia Tornado killed 32 people from Xenia to Wilberforce. About half of the buildings in the city of 27,000 were damaged and 300 homes destroyed. Nine Xenia churches were destroyed, as were seven of the twelve schools in the city. Fortunately, the tornado occurred an hour after classes had been dismissed. The roof and windows were blown from the Greene County Courthouse. A train passing through Xenia was struck by the tornado and 7 of the 47 cars were blown over, resulting in the blockage of Main Street.

More than 1300 people were treated for injuries at Green Memorial Hospital. Restaurants that were not destroyed handed out thousands of free meals to residents and rescue workers in Xenia. Convoys of generators, floodlights, bulldozers, and dump trucks arrived overnight from nearby Wright-Patterson Air Force Base.

The Illinois Reserve Militia was created in March of 1941 when the ILARNG 33rd Division was called into Federal service on 5 Mar 41. Untill the 33rd Div was inactivated on 3 Feb 46, The IL reserve militia performed the state level duties of the federalized National Guard. This type of force is what the 2nd amendment’s “well regulated militia” refers to.
