Court Term Ends With Obvious Frustration

Supreme Court Justice Stephen Breyer shook his head. He rolled his eyes. He even grimaced once or twice as he listened to Chief Justice John Roberts read the majority opinion in the school diversity case on Thursday.

As the high court ended its term, Breyer showed obvious disappointment with the opinion. For liberal members of the court, it was not the only time this year their emotions surfaced during normally placid readings of the court's opinions.

This is PITIFUL, CONTEMPTIBLE behavior! Highly reminiscent of Albore in the debate way back when...... do liberals think that behaving like petulant children is a good way to engage in a public debate of ideas???

wah wah wah-what happened to the Supreme Court Decorum. Can you imagine Scalia or any Republican appointees behaving like this? Well, what can you expect from handpicked (by Clinton) dem/liberal judges. Rules of behavior or for the little people. These legal giants can pout, whine and act like babies if they want. How embarrassing!

But parents sued after their children were denied admission to the schools they preferred because of their race.

And it was in support of barring children from schools because of their race that Breyer "told the hushed courtroom three times that the majority was wrong. So few, have so quickly changed so much."

Another proud liberal moment . . .

This term, the liberals on the court have lost almost every significant fight, said Thomas Goldstein, a Washington lawyer who argues before the court and follows it closely.

"They didn't have much of anything in the way of victories to make them feel like it was a balanced term," said Goldstein. "It came across as very one-sided.

"They can see that big shifts are coming to the right on the law," he said.

Bush's greatest legacy as president may very well be the nomination and appointment of Roberts and Alito to the Supreme Court. Nothing makes me smile more than to see the liberals' apoplexy over the decisions being rendered by the Supreme Court.

This guy is a typical liberal, except that he’s also on the SC. I respect his service to the country, but it’s time for him to retire. His great society ideals have proven to be impossible to implement fairly and equitably.

I don’t know about you, but I’m tired of this country being ruled by people who act more immature than my 16-year-old son.

Breyer acts like my kids did at twelve, and a few years back, during one of Bush’s SOTU speeches, Hillary was rolling her eyes and sighing like a tennage kid who wanted to go to the mall.

Regrettably, Breyer is fairly young (69) by Supreme Court standards. I would expect him to be around another 10-15 years before he retires.

Unfortunately not; This is typical liberal media spin; The obvious frustration with the Court should be from CONSERVATIVES; This Court is NOT conservative; Despite the spin, from a practical standpoint the school cases came out 4 to 4 to 1; Justice Kennedy only concurred in part; The decision did NOT overturn Grutter and find the use of race impermissable when it comes to school admissions; If anything, his opinion can be read as ENDORSING the ridiculous O’Connor “split the difference” opinion that will continue to allow schools to practice reverse discrimination in the name of “diversity” so long as they can claim race is only “one among many” factors considered -which of course it never is in practice.

It should also be noted that Kennedy sided with the liberals once again in the anti-death penalty case.

There are only FOUR conservatives on this Court, four liberals, and one moderate who is more concerned about getting favorable mention in the New York Times than he is about following the Constitution. We still need one more justice for a majority!!!

You know, these people didn’t have a problem with narrow 5-4 decisions overturning precedent back when it was a LIBERAL majority, now did they?

The liberal SCOTUS judges committment to the Constituion is nonexistant. They just want their agenda implemented. And now tears are flowing because its all being torn down, one wretched barrier at a time. Like filth being cleaned from a wall, the bright surface of the Constitution is starting to be visible again.

Well, I don't blame Breyer. It was a ridiculous opinion. Of course it's legal to assign kids to schools based on their race. Hasn't Roberts ever heard of Plessy v. Ferguson for cryin' out loud?

It is frightening that there is one, much less four, Associate Justices of the Supreme Court who believe that the Constitution even ALLOWS, much less REQUIRES, “diversity”.

I understand that it’s a limited ruling. But I also think a Grutter-type case might well turn out differently with this court. Kennedy will not sign onto any wide-ranging decision on either race or abortion. That isn’t news. I think there’s a good chance that school politics regarding race will now be more reasonable, and that would be good for many, many families across the country. I also think we’re making progress on the Court — a guy like Breyer (or, on the partial-birth case, a justice like Ginsburg) does not express anger and contempt just because they are only slightly unhappy with a result. The reactions of our enemies are always telling. I would take some real satisfaction in this. As for today’s death-penalty case, it strikes me as minor.

I was thinking today that this will probably the only good thing Bush has done. Tax cuts are permanent and the war is being run like a politically correct mess. But the Judges are great.

No doubt. If we could get just one more (most likely Stevens), we would have a great conservative majority for a number of years.

I’m amazed at the hypocrisy of the liberal wing of the Court when it whines about the conservative wing ignoring stare decisis regarding Brown v. Board of Education, but ignoring the stare decisis of Bowers v. Hardwick when it issued the Lawrence decision. I guess what is good for the goose is good for the gander.

Just a friendly reminder about the Bush court, the second judge Bush nominated was Harriet Myers and the American people once again spoke up and stopped that fiasco. The second judge nominated was as a result of the voice of American conservatives not George Bush.

I was not crazy about Harriet Myers. However, I do not believe that she would have been liberal. She was staunchly pro-life.

Somebody had to put the name forward. That was GW. The American people could have “spoke[n] up” and said they wanted a conservative justice on the Supreme Court and they wouldn’t have received one if John Kerry were in the White House.

Don’t deny Bush the credit which he deserves for nominating Alito and shepherding him successfully through the confirmation process.

There’s but one chance for redemption of the Dub in what’s left of his decaying orbit; he must replace one of the far left justices even if it means pulling out of Iraq.

If he can manage that, then I would let Hillary have the White House until her bowling pin calves came crushing down on her duck pin feet.
