DURHAM, N.C. -- Mike Nifong is now officially out of a job after submitting resignation letter to Governor Mike Easley Monday morning.
The disbarred and disgraced former DA had submitted a resignation letter that said his last day would be July 13.
But a citizen complaint put pressure on Nifong to make an early departure. Last week, Durham County Judge said in open court that Nifong's options were to either resign or the judge would take action.
Even resigning, Mike Nifong still signed his name as District Attorney in the letter.
The letter wasn't enough for Durham resident Beth Brewer.
She filed a complaint asking judge Orlando Hudson to immediately boot Nifong from office.
"You don't just leave it up to a defendant to submit his resignation and terminate the proceedings at will, that there is strong public interest in seeing the proceedings go on," Said Betty Lawrence, Brewer's attorney.
Judge Hudson decided an immediate resignation was good enough, saying Nifong's name is forever tarnished.
"With full disclosure, Mr. Nifong is absolutely unelectable," Judge Orlando Hudson said in open court.
Nifong was not in the courtroom today.The special prosecutor and judge Hudson both said it's time to move on from this legal nightmare.
The woman who filed the complaint says the judge maybe felt sorry for Nifong.
"I have nothing personal against Mr. Nifong, I'm just concerned that we're not following the law," Brewer said.

Poor Nifong. He did only what Democrats and most Republicans do: he pandered to blacks to get their votes.
Politicians know that if they do something, or appear to do something, for blacks that they will get the black vote automatically. Most blacks vote strictly along racial lines. “Who gives me and my people the most, gets my vote.”
hmm...ok. If he'll make McCain go away, I'll call off the hounds.
Sadly, Nifong could get elected in an all black district easily.
