It appears someone has launched a complaint against free dominion with the Canadian Human rights tribunal.

"Show me just what Mohammed brought that was new, and there you will find things only evil and inhuman, such as his command to spread by the sword the faith he preached." - Manuel II Palelologus
Being Canadian has all sorts of drawbacks.
Has a lawyer looked at to see if it is authentic? If it is legit then that is pretty disturbing on so many levels.
More evidence that true civil rights are weak in Canada.
Until 1972 (I think) they were a dominion.
They have a Charter not a Constitution.
NO Bill of Rights.
No First Amendment.
Not even sure if they have the principle of "innocent until proven guilty".
A nutcase (GLBT type)threatened to have the Pope arrested a few years back when he visited Canada.
There is no burden to prove injury, only a whiners claim that it has occured.
So, yeah, it's possible.
Personally, I am in for a monthly donation to help them get top legal representation.
Damn...is it just me or does this sound like the Canadian government is trying to strong arm Free Dominion into paying off the complainer?
Apparently, the absolute right to face your accuser does not exist in Canada, either.
Isn't that just swell?
Yeah, it sounds like an extortion scheme similar to what the ACLU runs here in the US.
touché
Looks like the time has come to move those Free Dominion servers OUT of Canada.
That would be my suggestion as well.
Second, unlike the USA, the "offended person" isn't the one who decides if charges are laid or not laid. it is the sole decision of the crown attorney. They cannot offer an out of court settlement. That alone tells me this is B.S.
Third, the crown does not pursue damages for the offended party, they only uphold the law, and prosecute violations of it without any intent to compensate the "offended" or victim for damages. They would have to seek damages in a civil court, much like in the USA, but is hard to do in Canada.
So, if someone is threatening Free Dominion with legal action other than the Canadian courts, it's all B.S. Unlike the USA, it's very hard to sue anyone in Canada. They've had torte reform ages ago, where we still have to put a stop to sue crazy people in the USA.
I can't get into the FD site, I haven't tried to post there in a couple of years, and it won't accept my name and password.
Actually I hope this is real. No time like the present to stand up to intimidation, whether directly or by "borrowing" the power of big-brother government.
I wonder who the best canuck conservative defense attorney is?
In fact. after reading a copy of the email, I can say without doubt that it is pure B.S. , an immature juvenile’s email sent by some twit who obviously doesn’t agree with the opinions posted by people who disagree with the leftist point of view in Canada.
Free Dominion would have been served by registered mail at the least, or by the RCMP personally if there was any such complaint.
Connie and party should simply phone the correct government department and ask if such a person works there.(There is no such government department in Canada called “Human rights”)
Looks like a blatantly phony extortion letter to me. Turn it over to the mounties.
The site works fine for me, although I didn’t try log in, as I haven’t posted there in years either, since I sold my house in Canada moved back to the USA permanently.
Time to rally around our allies to the North.
Here is what I have so far:
Thank you- I just became aware of this, here:
http://www.freerepublic.com/focus/f-news/1868213/posts?page=22#22
This is what you get from Political Correctness, “hate crimes prevention laws” and a hyperactive bureaucracy- let Americans beware of such excesses.
Bump- “for great justice!”
They already are sited in the U.S.
Indeed, the servers have been for years- but the Sysops, who I both regard as friends, are right up there in Beaverland, and subject their draconian PC laws and regulations.
Let's hope their lawyer can nip this nastiness in the bud.
The Canadian Human Rights Act protects anyone living in Canada against discrimination by the following federally regulated employers, service providers or unions :
* Federal departments, agencies and Crown corporations
* Chartered banks
* Airlines
* Television and radio stations
* Interprovincial communications and telephone companies
* Buses and railways that travel between provinces
* First Nations employers (for employment and service issues that are not exempt under section 67 of the Act)
* Other federally regulated industries, such as certain mining operations.
Free Dominion is not a federally regulated employer, service providers or union.
Hiya, fanfan... while my response is here-
http://www.freerepublic.com/focus/f-news/1868213/posts?page=22#22
- I’ll just add that Connie & Mark need to talk to their lawyer, to start sorting this out. It may be bogus— probably harassment from a banned member- but it has to be taken seriously until proven otherwise.
Thanks, fanfan.
This does not sound very credible. I certainly hope it is not.
Nathan, it is NOT an email that Connie (Free Dominion’s JimRob) received. It was a LETTER, sent to her mailbox by EXPRESSPOST, Canadian Mail. They goggled the name Human Rights Commissioner staff investigator who sent it and it is a real person working for said commission, and they also called the phone # (although after office hours) and got the voicemail of the said investigator.
While I hope it is a fake it appears it is legit.
Their HRC/IRS stunts were a very big part of the GOP win in 1994.
Remember, publicity is your biggest friend. I suspect you might be able to use this to convert a lot of people who normally vote liberal.
This appears to be a real threat:
From:
http://www.freedominion.ca/phpBB2/viewtopic.php?t=84457&start=165
“Results of phone call one:
This is real.
The file number they sent us was wrong. The correct file number is 20060657.
The agent asked Connie if she knew the first name of the complainant. We don’t know if the agent didn’t have the name herself or if she was trying to learn whether Connie knew it. We still don’t have the complainant’s full name.
We still don’t know what the complaint is. They didn’t tell us.
Connie was finally bumped upstairs to a supervisor but ended up at his voicemail. She left a message and that is where we stand at the moment.”
Yes there is a Canadian Constitution and a Charter of Rights. There are also freedom of speech and religion etc as in US First Amendment. And yes innocent to proven guilty.
This is not a criminal or civil court but what is called the Human Rights Commission. A kangaroo court to limit free speech under the Hate Crimes Law that is in direct opposition to the Canadian Constitution and Charter of Rights. The HRC are having ruling being challenged in the Canadian Court as we speak. The war is not lost it is being fought as is the case in the US with similar rights and freedoms.
You are aware that there are forces trying to bring similar hate crimes laws and Human Rights Tribunals to US?
I assume the title meant Human rights attacK...
It’s probably just a scheme by a leftist to get FD banned. They come up with some reason why it constitutes a human rights offense and get the government to listen.
I used to post on FD but I haven’t been on for awhile. I outta go back.
Yes, I am painfully aware.
Neurotics trump the Constitution?
Sandmaggots can scream "Death to America" and enjoy 'protected speech'?
BUMP!
Perhaps they should seek political asylum in the US based upon political and religious persecution.
Good idea, but I guess that nixes my plan to move into their basement if Hillarrhea! wins in 2008...
Thank you- I will pass those on.
Thanks. I’d go myself as I’m registered there, but my computer is showing me as not logged in to Free Dominion and I can’t remember right this minute what ID/email addy I used to register.
It looks like the date of the letter and the demand deadline for response is totally unresonably brief.
I would think that this sort of improper service and demand would be cause for all sorts of extensions and demands for details by their attorney.
Have they said if they have secured one yet?
I tried to skim all the pages but didn’t see that mentioned.
Last I saw, they were still trying to get through on the phone to an actual person at this CHRC office where the letter originated. A member of FD did post this:
I have talked to a lawyer with a VERY large federally regulated employer. She has worked 20 years dealing with human rights and has handled 500 or so complaints.
She said the CHRC must provide you with:
The section of the act allegedly violated.
The nature of the complaint
The complaint as provided by the complainant to the CHRC.
She says DO NOT respond to the complaint until you have ALL the info you are entitled to. Meet with the investigator first if you have to.
Sweet!
When FR went through its first legal difficulties it was fortunate that we had some people to get us started in the right direction. I hope they plan out issues of fees and that sort of stuff as legal assistance can mount up to a lot of hourly charges if you just leave it on that basis and the parties at both ends of the relationship can end up very disappointed with the costs or reimbursement, as we all saw in our case.
And into Fresno...
Amen!
I have been trying to keep this thread bumped, and also trying to get into Free Dominion, but I can't remember my password and am waiting for login help.
I'm in for $5 a month forever, if that's what it takes to slap these losers down. If 10,000 other Freepers do likewise, FD can have some first class legal help.
I’ll be starting a legal defense thread very soon
