Judge voids Pa. city’s illegal immigration law

ALLENTOWN, Pa. - A federal judge on Thursday struck down the city of Hazleton's tough crackdown on illegal immigrants, ruling unconstitutional a law that has been emulated by towns and cities around the United States.

The Illegal Immigration Relief Act sought to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that give them jobs. Another measure would have required tenants to register with City Hall and pay for a rental permit. It was pushed by the Pennsylvania city's Republican mayor last summer after two illegal immigrants were charged in a fatal shooting.

Immigration law is one of the very things actually given by the Constitution to be under the jurisdiction of the Federal government. So in that sense, I think the Court got this right. Now if only the Federal government would DO what it is supposed to. If there is a legitimate reason to impeach members of the Bush administration, it is this.

Judges must protect the civil rights of illegals, and twist the constitution. Protecting the rights of citizens and having a safe, clean, place to live is old fashion. American citizens must learn their place in the NAU.

Isn’t it illegal to employ illegal alliens?

I don’t see how it’s unconstiutional to prosecute those who employ or house those who are here illegally.

This is just another example of judicial tyranny.

Federal judges are the problem... not the solution in safeguarding our sovereignty. What do they think - the people should stand passively aside when the federal government fails to act? They don't get it either!

Here is the coverage from the local paper; it has two videos, one from Mayor Bartlett ans another by the editor of a Spanish-language paper.

The Morning Call [Allentown, PA] ^

Appeals next in Hazleton case

A federal court judge today struck down Hazleton's illegal immigration ordinance, saying it violated due process protections and was unconstitutional.

U.S. District Judge James M. Munley, in a much anticipated 206 page decision with national implications, also ruled that the ordinance violated the nation's Supremacy Clause, which acknowledges federal law as the supreme law of the land.

Trib -- Please reping the list; thanks.

I'm sure everybody will be banging down this judges door to have him thrown off the bench.

Nothing, and I mean NOTHING will happen to this guy.

It's time to wake up people, these judges are flat out doing as they please because they know that nothing will happen to them.

Lines are being crossed.

I wrote this on a later post but frustration is setting in...

Sometimes, just sometimes, I wish that we could behave irrationally like a roving gang of idiots (like the illegal alien marchers and supporters) and just burn stuff when we don’t get our way. How come you don’t see conservatives riot, loot, burn, etc. when politicians and judges continue to ignore the will of the American people? I knew that this liberal judge would strike down the Hazleton ordinance just as other liberal judges did with other initiatives such as Proposition 187 in California. I’m pretty sure I’m too sane to resort to hooliganism, but if this defiance of immigration law keeps up, I may just go act like a Reconquista.

Time to file Racketeering, Influencing, and Corrupt Organizations (RICO) lawsuits — INCLUDING against THIS JUDGE.

RICO lawyers could turn it around in a few years and MAKE MONEY at the same time. I’m surprised they haven’t done it already.

In the absence of enforcement, we can get the word out in the meantime that there is money to be made in filing RICO lawsuits against employers who hire illegal aliens.

Employers would have no trouble shutting down the border if they could get sued by someone under the RICO statutes for hiring these people in the first place. The next time an illegal alien kills someone in a drunk driving accident or somesuch thing, I’m going to point out that the victim’s family might be able to seek compensation from the employer under these statutes in the hopes that it would catch on. If this did catch on, would see such a swift backlash against illegal immigration that no employer would go near these people and they’ll all simply want to go back home.
