You’d think that, given all this political cover, Bush would spring them. He would have nothing to lose and a lot of good will to gain.

By the logic of this amendment,if the dems were to get enough control and want to defund the President's secret service agents they could. This precedent would give Congress complete control over our government, effectively neutering the other two branches. They could defund any aspect of any other branch. I don't think these guys should have been given this harsh of a sentence, but I also don't think giving Congress complete control over the other two branches is the answer.

P.S. If this goes to court and they don't like the outcome they could just 'defund' that judge.

Well yes I think they could. (granted, I’m no Constitutional scholar)

The President could veto the bill. Congress could over-ride the veto.

Congress was designed to be very inefficient and slow but with immense power.

And finally if “We the People” don’t like it, we can elect other representatives every 2 years.

Maybe that is why Duncan Hunter didn’t vote. That also might force the President to veto it. And that will become a propaganda nightmare :(

If you say so. I don’t read Congressional ability to abolish the other two branches in the Constitution. Maybe I don’t want to see it. Either way, I don’t like this precedent. The guys should not have been punished that harshly, but this looks more like an election stunt. Just my opinion.

And I respect your opinion,however Congress does control the purse strings and they can fund or de-fund whatever they choose. That’s one of the reasons we’ve been hearing so much about funding for the Iraq war !!!

I understand that. This looks more like an ex post facto issue here though. I don’t think a judicial challenge to this precedent would stand.
