If they change the punishment for a crime, not only after it’s committed but after it’s been adjudicated and sentenced it could easily be considered ex post facto. The Constitution doesn’t allow, in fact its specifically prohibits them from doing that. It could be argued, since they are in fact changing the punishment ex post facto (after the fact).

Actually the article is talking about if Congress has the right to hold back financing from the prison system and it sure as hell has the Constitutional right to do it. Hurrah to Duncan Hunter for this move !!!
