THE FELONIES CAUGHT ON TAPE - SMOKING GUN VIDEO
Hillary Clinton's counsel, David Kendall, today attempted to avoid oral arguments scheduled for the California Court of Appeals on Sept. 7, 2007 in the historic civil case, Paul v Clinton.
Kendall had his affiliate counsel in Los Angeles, Jan Norman, contact Peter Paul's counsel.
Norman told Collette Wilson of the United States Justice Foundation, "I got word from the boys back East that they would be willing to waive oral arguments in the case." (BWAHAHAHAHAHAHAHAHAHAHAHA!)
Wilson's response, was a very quick, "No thanks."
Norman finished with, "Well, I didn't think so, but I thought I'd ask." (Another BWAHAHAHAHAHAHAHAHAHA!)
Of course Kendall doesn't want to engage in oral arguments before the three-judge panel. He is going to have to tell them why his client is not a felon and the anti-SLAPP provision that removed her as a defendant at the superior court level should stand.
After a two-year battle for return of documentation and home videos, Peter finally was given possession of a 5-minute conference call on tape with Hillary that he calls the "smoking gun video." On that video, Hillary is shown to be soliciting and participating in a hard money, in-kind contribution that would ultimately be more than $1.6 million.
To set up why that video was is critical to Peter's case, it is important to know the involvement of Hillary's agents in the Hollywood Gala. On June 23, 2000, after a Hillary fundraising event in Chicago in which Olivia Newton John performed, the idea was hatched to have a major fundraiser in Los Angeles just before the DNC convention that started on August 16. The idea was the brainchild of Kelly Craighead, head of Hillary's advance team, and Jim Levin, business advisor to and eyes and ears of Bill Clinton in vetting Peter and Stan Lee Media. Clinton wanted someone gathering the information about SLM to verify that the deal for him to come aboard the company for one year as a rainmaker was a bonifide deal. Levin was also on the Clinton Library Board of Directors and happened to own a fence company in Chicago. Oh, yes, he at one time owned the Doll House in Chicago, the strip club that popularized the lap dance. He was said to be the lap dance provider to the president.
Participating in a conference call on July 11, 2000 were Peter, Craighead, Levin, Aaron Tonken, David Rosen, and Howard Wolfson. Peter was solicited to pay half of the cost of the Hollywood Gala, and Cynthia Gershman, Beverly Hills philanthropist and wannabe actress, was expected to pay the other half. The number $1,050,000 was used during that call. Ultimately, Peter paid that amount himself and several hundred thousand dollars more.
Kendall has maintained for six years that the fundraiser was a soft money contribution. Part of his argument is that those involved were part of the joint fundraising committee. A joint fundraiser is used as a way to raise large sums of money and not have to report them as a direct hard money contribution. Not so fast, David. Kelly Craighead, agent for Hillary Clinton, was not part of any joint fundraising committee. She was a White House employee. Her solicitation of that money as agent for Hillary made the entire amount paid by Peter a hard money donation and illegal under campaign finance law.
In the smoking gun video of July 17, Hillary acknowledges that Kelly is keeping her completely briefed. She offers any additional help Peter needs in putting on the event. She even discusses how she solicited Cher's performance. Cher's performance, which could have had a fair market value of $200,000, should also have been declared as a hard money donation.
Until Peter saw the list of documents he was to be receiving, he forgot that he had recorded that July 17 call. He was frankly amazed that an asset of Hillary's within the Justice Department had not destroyed that evidence. He believes that some low level functionary made a mistake by acknowledging its existence. In fact, when Peter got the shipment of documents and videos, that video was not included. His counsel argued with the Dept. of Justice until they finally acquiesced. It was on the manifest, so they could not say they didn't have it.
Of course, Kendall doesn't want to be grilled in oral arguments by the three-judge panel. In reply to Wilson's brief, he made an argument as to whether the taping by Peter was legal. Sorry, David, there were several people listening, and it was a conference call on a speaker. There was no expectation of privacy.
If justice is served, the three-judge panel should decide in about 10 days that Hillary's actions bar her from anti-SLAPP protection, and she will be back in the case as a defendant. If if the decision goes the other way, Hillary will still be forced to testify under oath. I was in the courtroom last year when Judge Aurelio Munoz said, "I will entertain no motion that prevents Senator Clinton from testifying...did you hear that, Mr. Kendall?"
I had two other interesting converstions today. The first was with the NY TIMES reporter who wrote the story of Hillary's letters when she was at college. I provided him with the video of Hillary discussing with Peter at Spago her Dartmouth blind. The guy got drunk, put on his swim trunks, took his surfboard, and was navigating the snow-covered little hills on the golf course. The reporter was astounded that Peter has been able to get extensive home video of Hillary. He could not believe that Hillary would have ever allowed it.
The other call was with Dave Schippers. Dave was very pleased to hear that we are getting closer to the magic day when she is under oath. He was also amazed that Peter is now in possession of the smoking gun video.
I don't believe Hillary will ever wear an orange jumpsuit. The best thing for which we can hope is that the voters are finally shown the truth about the greatest campaign finance fraud in history, the compromising of all three branches of government, the mainstream media news blockade, the continuing obstruction of justice, the four false FEC reports, and the Clinton role in the collapse of Stan Lee Media.
When the truth is known, and all of America finally sees the real Hillary Clinton, we hope it makes a difference.
And Hillary’s solicitation and participation also made it hard money and illegal.
Martha Stewart went to prison for less.
BTW, Martha Stewart went to prison specifically to protect those doing the real insider trading, and, allegedly , one of those was Hillary Clinton.

(There is a)$2,000 limit on direct donation to a candidate. The 1.6 mil spent by Peter (Paul) was not for a joint committee or for DNC party building -- it was specifically for her campaign. She and her agents solicited, participated, and coordinated. All but $2,000 was illegal from the beginning. She has filed four false FEC reports and undoubtedly IRS reports.
