To answer your question the Patriot act allows for a "Administrative supeona" and is a clear violation of the 4th amendment.
Who has ruled it unconstitutional? Ron Paul? SCOTUS? The ACLU has tried very hard to get the Patriot Act repealed, as hard as Ron Paul, but they can't because it is constitutional, at least until it declared otherwise.
