Mr. Savage,
Some time back as I was researching the anchor baby issue, I found that for someone to have citizenship, or their babies, he/she must owe allegiance to this country, for example permanent residents of a territory.
Illegals continue to owe allegiance to their own country even when they are here; they never renounce their allegiance to the old country, nor affirm allegiance to the USA even though they intend to stay. Therefore like the children of ambassadors the children of illegals are not citizens.
Since citizenship is a function of allegiance all one need do is ask the question, to what nation does the child's parents owe their allegiance? If it is not the U.S., then the child is not a citizen.
Because of this misunderstanding, the citizenship given to these children is tainted. Further, the allegiance to some South American country still exists and therefore they are citizens of that South American country by default. So there is a dual citizenship at work, one legitimate, the other tainted. Because of the error, there is grounds to rescind or annul the tainted U.S. citizenship, an act which would not leave the child stateless. The default legitimate citizenship to the South American country would remain. Judges could fix this fast if they'd consider the allegiance angle, and without amending the Constitution.
