Boss A Jerk? Think About Suing Him

Is your boss a nightmare? Not just annoying, but so completely lacking in people skills as to possibly be a sociopath?

There may now be more you can do than simply renting "Office Space" for the 11th time. The Los Angeles Times reports that lawmakers across the country are considering legislation that would give workers grounds to sue their superiors "for being, basically, jerks."

The specific standards for behavior that would justify such lawsuits are still being worked out. At least four state legislatures, including those in New Jersey, New York, Vermont and Washington, are considering such a measure

New Zealand has a freer business environment than Australia and the USA according to the World Bank. Might be nice there.

Oh, perfect. Let’s give more power to lazy, incompetent employees that claim they are being picked on by a boss that expects them to actually work. I’ll admit I’ve worked for some real jerks for bosses in my career that usually were threatened by an ambitious-hard-working subordinate, but that was easily fixed. I found a better job!

Odd that CBS would publish this, especially considering Perky Katie's fine style of management. I wonder what would happen if some of the CBS "little people" would go after her with a lawsuit?

Australia (and New Zealand) are way liberal, and have extremely tight immigration laws (I know you were just talking, just saying :) )

I dont know about this-we just survived 5 years of a terrible boss. Threats of violence, showing up drunk, and meltdowns at meetings. Sadly, I was the impetus for getting fired. I called him on a recorded line when he was the duty officer over one weekend. He was so drunk he didnt even know what I was telling him. We had a serious inflight emergency involving smoke in the cabin and cockpit which resulted in a diversion. When he didnt show up on the conference call, I tried to cover for him, but the VPs werent buying it. The pulled the tapes and canned him. He then spent the next two weeks calling flight control blaming me for his firing, and threatened to fail me on a drug test. We had to get a TRO against him..

When I was the boss, I guess I was a jerk. I demanded a full 8 hours work for 8 hours of pay. If you failed to perform, you heard about it from me, in person... and if you continued to under perform, it affected your pay raises and promotions.

I could have been sued for demanding performance.

Odd. Our legislature's last session ended months ago and the next isn't until January.

Ah yes....another reason to bring a law suit. What’s the matter with people? If your boss is a jerk, go find another job. Enough people leave his department, his boss will get rid of him. When the industry changed from Personnel Departments to Human Resources, all this crap started. Little Hitlers were set up and think they control everything. I had a run in with HR one time. I wanted to fire a person. HR said “Well, maybe we can fix the problem by giving the employee some time to correct the problem.” I told this guy that “his job was to process paperwork and my job was to run my department. I already documented this person for 6 months, according to company regulations. Fire her and do it now.” This HR guy just leaned back and gave up. Managers of people have not only a responsibility to their people but their main job is to turn out products. Without products......no company. These people need to get a life. I’ve worked for jerks, thankfully, not many. If I found a jerk, I went someplace else.

Unfortunately, for every situation like this, there will be hundreds of jerks who don't want to work egged on by trial lawyers pushing the limits of what violation of the statute means. A substantial portion of those jerks are willing to lie to win the jackpot.

I don't know how you run a business under this sort of abusive law. Maybe video everything that happens in the business and archive the tapes.

I had a top manager at an electronics firm one time that retired. On his last day, he took a chainsaw and cut his desk in half. The next day, he had a new desk delivered but he got his point across.

Sounds like a plan, think they’ll go for it? (Not even liberal Australia is that suicidal! Only in America!) I will do everything I can not to hire employees. My partner and I run our small company and at times it can be tough. But....I don’t want employees if I can get away from it.

Wouldn’t you be in contempt of court? Then you would have to fine yourself. Sounds like a loosing proposition to me. Maybe you could hire Shark? Maybe half of you could bribe the judge and the other have could protest.

Been there, like the place and didn't want to come back home ! Very nice and friendly people. In Queenstown, was invited for some wedding bachelor party to drink but had the stomach flu so had to decline.

I saw a New Jersey State Congresscritter being interviewed on Fox this morning. She actually said that the law would depend on the discretion of trial lawyers to be responsible in their acceptance of law suites in order for it not to be abusive to business!!!!!!!! Anyone want to go bossing just now?

It depends. I had quite a few that were demanding and fair and skilled at making people WANT to give their 8+ hours.

There have been a few that should never have been allowed to advance. Usually they were made managers to get them away from sharp implements. These are the ones who violate the Fair Labor Standards Act with harrassment, intimidation, and bombast, and they serve as a glowing testimonial to the restraint, self-control, and responsibility of the American Gun Owner.(And in some cases, it is a shame).

Egad, 99 percent of this country must be effectively BRAIN DEAD. This is BEYOND stupid. It's so far beyond stupid it's somewhere in a neighboring galaxy and heading away from rational thought faster than the speed of entropy!

Nobody but trial lawyers will benefit from such a ridiculous law.

This is the group that thinks displays of severed penises and Christ covered with urine and feces is "art", supports laws forcing elementary school kids to learn fisting and worship vaginas, calls everyone who doesn't agree with them 100% vile names while ALSO PUBLICALLY wishing bloody torture on their enemies...among many other things. How good a definition of good behavioral standard do we THINK people like that can create??

WHY is it that nearly everyone in this country thinks blaming Bush for all their ills is more important than demanding our lawmakers MAKE DECENT LAWS??

Another knife to the capitalist system. What will happen is that companies will stop hiring employees directly. They will hire long-term temps who don’t directly work for their company. Talking about driving prices up. For everyone.

There seems to be a reason to sue for everthing. Last week I was ploughed over by a shoplifter trying to escape. The store was utterly shocked that all I wanted from them was payment of my doctor bills (to make sure I was just bruised, not broken).

What about co-workers?
I work with a female who thinks she walks on water and is not afraid to bad mouth and berate anyone or anything. She curses and mutters all day long as if she is in a make the sailor blush contest and no one dares to confront her, even the boss. She creates a very hostile work environment and this has been going on for years.

that went out the window with the “right to work” folks demanding equal rights (outcome). When every employer in America lost the right to hire anyone they wanted, and were told to “accommodate” the employees they couldn't really use, employees gained the upper hand. We are slowly becoming the Soviet Union....

You're smart. My husband and I had a company in Florida some years ago. We started growing and getting more customers, started hiring, etc. We eventually figured out we actually made more money when it was just us than we did with employees, what with unemp. tax, matching FICA and Medicare taxes, worker's comp insurance, and everything else the bureaucrats nickel and dime you to death with.
