We'll Sue Murtha, Chessani Lawyer Vows

If Marine Col. Jeffrey Chessani is exonerated of the charges against him he may haul Pennsylvania Democratic Congressman John Murtha, into court, suing him for libel, one of his lawyers told NewsMax.com.

Brian Rooney, one of the attorneys at Michigan's Thomas More Law Center representing Lt. Col. Jeffrey Chessani and a former Marine captain himself told NewsMax.com that his client, who is alleged to have failed to fully investigate the killing of 24 Iraqis in Haditha November, 2005 and not reporting an alleged Law of War violation, may follow the example of another Haditha Marine, SSgt. Frank Wuterich who is suing Murtha for libel.

Murtha set off a media firestorm last year when even before the matter had been fully investigated he charged members of Kilo Company, 3rd Bn, 1st Marine Regiment had gone on a rampage and slaughtered 24 Iraqi civilians in cold blood to avenge the killing of a member of their unit in an IED explosion. He also said that the incident occurred in the absence of any firefight, although it occurred as part of a day-long battle with insurgent ambushers that wounded 11 Marines.

Well, well, well, seems the Pennsylvania worm has turned. Very interesting to see where this one will go. Hopefully it will take Murtha downt the tubes and cost him alot of money.

If I missed the complete dropping of charges against this particular man, then I would agree that this news being made public is great. But it sounds as if that has yet to happen and so is premature from a tactical point of view, though I fully sympathize with those accused.

Yeah, that whole presumption of innocence thing is so not in vogue anymore.

It has nothing to do with the presumption. It has to do with the fact that the charges have not been dropped. That is a predicate for the legal action they are contemplating.

This might be legalese that some would understand, but how about the rest of who do not have legal backgrounds ?
Can you put your answer in layman’s terms?

Nah, I think that this is a fairly appropriate response and his timing is excellent.

Note the opening sentence: "If Marine Col. Jeffrey Chessani is exonerated of the charges against him he may haul Pennsylvania Democratic Congressman John Murtha, into court..." (italics mine)

Look at it this way: Chessani knows he's innocent, and Murtha knows he's innocent. When charges against him are dropped he is poised to react. Should he be railroaded, he just never follows through with his threat. Either way, he applies pressure to that worthless SOS and (hopefully) makes him sweat a bit.

Hmmm...let me get this straight. The Colonel is charged with covering up a ‘crime” that never happened! (even though in moonbat think it was a crime because any American serviceman protecting himself is guilty of something) So what will he be convicted of other than being an evil US baby killer-starver-torturer?
