Iowa Judge Says Marriage Not Just Man, Woman--Ruling: Law Defining Marriage Invalid (MUST READ!)

DES MOINES, Iowa -- A Polk County judge has struck down Iowa's law preserving marriage for only a man and a woman. He ordered the county recorder's office to issue marriage licenses to gay couples.

Six gay and lesbian couples went to court for the right to legally marry in Iowa.

Lamda Legal filed a lawsuit in 2005 on behalf of the couples in Iowa, saying they deserve equal protection under the law.

Des Moines laywer Dennis Johnson represented six gay couples who filed the lawsuit after they were denied marriage licenses, and he says Hanson's ruling is a moral victory for equal rights.

Judge Robert B. Hanson ruled that couples cannot be denied licenses to marry or marriage certificates or "in any other way be prevented from entering into civil marriage pursuant to Iowa Code Chapter 595 by reason of the fact that both persons comprising such as couple are of the same sex."

The county is expected to appeal the ruling to the Iowa Supreme Court.

"Today's civil-rights ruling by Judge Robert Hanson is another step in what is expected to be a lengthy legal process. The prudent approach would be for the Legislature to await an expected appeal and subsequent ruling by the Iowa Supreme Court before taking any steps in reaction to this decision," said Senate Majority Leader Mike Gronstal in a statement.

For years, Iowa Republicans controlled the state house and governors mansion. For years, they told Iowa conservatives that a marriage amendment wasn't needed and that Iowa's DOMA was all that we needed. While we conservatives knew better, party hacks parrotted the party line.

Democrats will be democrats. This defeat can be set at the feet of republicans.

Next time a Republican tells you a marriage amendment isn't necessary, you know they're a liar.

Let me see now. In various circumstances, it is illegal to smoke in public although smoking is legal. It is illegal to have a gun(s)even though it is a right given to me by the 2nd amendment. It is illegal to be in public while intoxicated (@.08) but is legal to drink. At least if I am gay I can now marry, altho there are still some sodomy laws on the books, and the laws have only been strengthened re: prohibiting gay unions. Isn’t their something wrong with this scenario?

I love how the liberals use the claim of precidence to get away with what they want to do, for instance Roe vs Wade. But if precidence goes against them it’s a so-what issue, ground-breaking don’t ya know.

This should be a wake up call for social conservatives. These activist judges can go ahead and keep this up. It will be a rallying cry for a get-out-the-vote effort in the next elections. Provided the Republicans put forth candidates worthy of major grassroots efforts. Rudy,etc ain’t gonna do it.

Simple enough. What gives the court the idea it can arbitrarily ignore the law? Doesn't anyoone realize that the court made a mockery of the rule of law?

If this stands, it will encourage the courts to re-define any word.

Looks like the judges have taken over the country without firing a shot.

There are no sodomy laws on the books anymore. SCOTUS invalidated them all back in 2003. Lawrence v. Texas.

This judge is a nut.

A relationship between a legally joined man & woman is unique in its procreative potential. Due to that procreative potential the state has an interest in steering those with such potential into a certain legal status which the state can easily monitor. The name for such a legal joining is “marriage.”

The state has no interest whatsoever in whom anyone loves or wants to have sex with. They have an interest in the potential production of children.

Now lets get God's ruling on the matter. "civil marriage"... OK. Hmmm. Now they can legally spread their HIV/Aids. The lawyers will have a hay day with "divorces" among the homos. They change partners faster than square dancers. I'm glad it will be expensive for them.

But God. Now that's another issue. A much more important one because no one has conned Him into changing His mind on the matter. Thank You Lord that we can count on You to never change.

As for this judge, I don’t know the IA protocols for removal, but hopefully his decision will be soundly shot down at the appellate level. If Iowa really wants to remain the first caucus state, chances are the ruling won’t survive appeal. Imagine: “Iowa-the FIRST gay voting state in America!” That oughta go over great...heh...

My guess is that in the coming days you will find that this case was carefully orchestrated. That the plaintiffs carefully and methodically maneuvered this case to one Judge Robert Hanson who is either a homosexual himself or is personally very sympathetic to homosexual demands. In either case, I doubt this ruling is built upon any case law, rather, we have some hick judge who is legislating via judicial fiat. This is exactly the type of judicial activism that is the hallmark of liberalism. Create dictates for everyone via personal capricious irrespective of the electorate at large. The guy should be impeached.

Interesting what I'm seeing on TV. I haven't seen one Democrat relishing in their "victory". Even slimebag Culver is saying marriage is between a man and a woman. The Democrat County Attorney is asking for a stay.

Democrat Senate Majority Leader says we need to wait before jumping on the need for a Constitutional Amendment.

Heard Culver is going to divest himself of the filthy lucre from the Democrat criminal Hsu that "forgot" he was supposed to be in jail.

Today's Democrats are corrupt to the core.

Now, if the Republicans will just focus on pointing out to the brain dead voters of Iowa that it is Democrats who are responsible, we might get some sanity back into the legislature or governor's office. Of course, that's the crux of the issue.

At least Iowa has Congressman Steve King. He speaks more wisdom in one sentence that all Democrat collectively in this state. He’s not going to let up on this one.
