Excuse me? He got his hand rightly smacked. Mind you he ignored pretty much the rest in his drive to destroy the Republic but at no point in this nation does the Constitution 'not apply'. The ruling by this judge was correct. Hopefully the rest of the 'patriot' act will eventually be overturned.

Her ruling is laughable:"For over 200 years, this Nation has adhered to the rule of law—with unparalleled success. A shift to a Nation based on extra- constitutional authority is prohibited, as well as ill-advised," she wrote.

To say it is ill advised is a value judgment and of no significance. The prohibited part omits that extraordinary times often call for extraordinary measures.

So true! As far as I can tell, terrorism is what ever the government says it is. It all depends on who is running the show in DC. Just wait till Hillary has the powers that Bush now has. Just remember that EVERY power Bush as said that the executive branch has, Hillary will have them to.

As a rule of thumb, I do not want a conservative POTUS to have any powers that I would not want a liberal POTUS to have. What come around goes around. We must always keep that in mind.

Good catch. The judge in the Klamath Falls case. We must have had hundreds of threads mentioning it and all the citizen protests here at FR.

I am willing to bet that EVERY complaint and gripe about the Patriot Act will end, once She Who Must Not Be Named is in the WH in 2009.

To the contrary - I am willing to bet that conservatives will finally get upset about Patriot Act warrantless snooping of private citizens, when it's Hillary's federal police who are doing the snooping. The big government powers that Bush is building will be used by Hillary to go after conservatives. Maybe then conservatives will recover their principles and start opposing Big Government again and standing up for Constitutional protections against government abuses, again.

Really? Including the Second Amendment? You're saying that in time of war, government can confiscate our gunds? What about religious freedom? In time of war, President hillary can shut down churches - for example, evangelical churches - that criticize her? Be very careful about agreeing to the suspension of your constitutional freedoms. When a Democrat gets into the White House, you may miss those freedoms very much.

The court also seemed skeptical that there was probable cause to establish that Mayfield was an agent of a foreign power, or that he was involved in the bombing, because US authorities knew that he had no passport, hadn’t been out of the country, etc.

Yeah, luckily there is no phone or internet thing out there either.

Anyone happen to have the wording of said USC as "...amended by the USA Patriot Act" or do we have to keep commenting on each other's knowledge?

Not true.

Please read the Constitution and Bill of Rights.

Pay special attention to each place the Constitution mentions to word "Citizen" and where it mentions "People."

Read over the 14th Amendment's Equal Protection Clause for clarification.

The Mayfield case was Keystone Kops at its finest. The FBI made a print match to Mayfield, but didn’t bother to double check. They didn’t even bother to find out if he was in Spain at the time. They grabbed the Patriot Act and went looking for anything incriminating. How much money was wasted - not including this $Million?

You’re assuming that the same courts and politicians who won’t let us enforce our laws will let us stop immigration. Well in their minds, being allowed in is just as much a right as free health care, driver’s licenses, and a well paying job is to those already here illegally.

If the powers-that-be would get serious and shut the borders, than all the other stuff wouldn’t happen to begin with. We need to keep up the same pressure we did this summer over the amnesty bill. Not one of those who supported this bill should get reelected come next Fall. Think that will happen?

Until our Government gets serious about physically securing our Nation, I find myself in opposition to any act that puts more pressure on our Citizens than it does on those invading and trying to invade our country.

It’s funny how we continue to allow the government to make us wait like cattle and sheep at airport terminals before we get on a plane to travel within our own country, but this same government absolutely refuses to close down and control it’s borders against invasion.

On second thought, sheep don’t really care.

Believe me, I wish what you said were true but if you doubt me ask a black man about his Constitutional rights in the early 1800’s. Or ask an American Indian about his rights in the 1800’s. The Cherokee won their case in front of the Supreme Court, right before they left on the Trail of Tears.

There is theory and there is practice. In theory the Constitution is wonderful. However in practice we only follow it when it is convenient to us. (I’m not happy about that but I can see what the reality is.)

I did get a bit of crap over it

Mind you, I’m not happy that we don’t always follow the Constitution but I’m a realist.

We use the Constitution when it is convenient to us. The main guiding principle in all human life is ‘might makes right’.

Freedom is a difficult concept for so many. Tyranny is so much easier.
