Fund-raiser Norman Hsu: Dismiss rap, give back my $2M bail

REDWOOD CITY, Calif. - Jailed fund-raiser Norman Hsu wants his 15-year-old fraud rap dismissed on a technicality and a full refund on the $2 million bail he skipped out on three weeks ago, his lawyers said yesterday.
Hsu looked frail in a waist shackle and orange jail uniform as he appeared in a San Mateo County court. He uttered only a single "yes" when Judge Stephen Hall asked if he had agreed to a five-week postponement of his attorney's motion to throw out his 1992 "no contest" plea.
Outside, attorney James Brosnahan said he would press the court for a dismissal or a new trial on the grounds that the judge who originally accepted Hsu's grand-theft plea in the $1 million Ponzi scheme is now retired, and it would be improper for a new judge to impose the sentence.
Apparently, Hsu's defense to skipping out on his sentencing hearing in 1992 and spending 15 years as a fugitive will be that he was partying in the public eye, all but inviting oblivious authorities to come get their man.
"Hsu was around and visible in California, contributing to California politicians," Brosnahan said. "You could find him literally in about one minute of effort ."
Brosnahan also said he'll file to get Hsu's $2 million in forfeited bail returned, and he confirmed Hsu tried to take his own life during the bizarre flight from justice that ended at an Amtrak station in Grand Junction, Colo.
"He was hospitalized in Colorado under the influence of pills he had taken in an attempted suicide," Brosnahan said, adding that he considers that any statements Hsu made to the FBI while hospitalized were illegally obtained.
Last week, federal prosecutors in New York filed their own complaint against Hsu, accusing the Hong Kong-born businessman of running a separate $60 million Ponzi scheme.
Presidential hopeful Hillary Clinton, Hsu's biggest beneficiary, has said she's returning some $850,000 that Hsu, 56, helped her raise. Ronald Smetana, the prosecutor here, said he'll oppose a new trial, but is prepared for one.
Did they ask him who helped him obtain that train ticket?
Yeah, how'd returning that money work out? Has anyone heard anything about that?
I expect it to be China.

They kind of have a point.
Brosnahan doesn’t give a fig about Hsu. He is being paid to protect Hillary Clinton and other Dems. Did we ever figure out who’s paying for Brosnahan?
Hasn't she been "doing" this for about three weeks now?

There is way, way more here than meets the eye. I sure hope this doesn't fall between the cracks.
And if they ever release Hsu, he'll be gone in a NY moment never to be seen again.

The Senator from New York has sent Mr. Hsu an invitation for a picnic in the Park to discuss his continuing "visibility".
Novel idea. So I guess defense attorneys should seek out elderly and ill-appearing judges, and then suggest that their clients take off and disappear before sentencing. Then, when they're caught, they can walk free!
I could never argue something like that without convulsing with laughter. His lawyer actually said that with a straight face? Now I see why lawyers earn as much as they do!
Something tells me this guy is not long for this earth...
The argument his lawyer makes that because the judge who originally tried him is retired, he gets the conviction vacated won’t fly: he fled as a fugitive, a felony in itself, and he cannot take advantage of his criminal act to protect him from being sentenced.
But they can’t use it both ways. They want to say that it should have been easy for him to be picked up for his crime, but that all the recipients of his largesse are innocent dupes for not knowing?
