A special session of the Live Oak County Grand Jury convened on Oct. 15, because two men that are alleged to have committed sex acts on children were close to reaching 90-days in the LOC jail. In Texas, if the accused is in custody, the Grand Jury must return an indictment within 90 days or the accused must be released on personal recognizance.
Live Oak County Sheriff Larry Busby said, The accused Luis Manuel Garnica-Ruvalcaba, 25, is an undocumented immigrant from Mexico, living in George West. He was employed by the Taqueria Jalisco. Following an investigation by George West Chief of Police Ray Garcia, Garnica-Ruvalcaba was arrested on July 23, 2007, for aggravated sexual assault. Within 48 hours of his arrest, he was magistrated by Judge Endercio Chapa Jr., who explained the charges against him, informed him of his rights, and set bond at $100,000.
Busby said, Three more allegations of aggravated sexual assault were added on August 2, 2007. The accused was subsequently magistrated by Judge Dawn Benham who set additional bonds at $150,000 for each count. Garnica-Ruvalcaba did not post the bonds and remained in the Live Oak County jail, said Busby.
The Grand Jury returned four indictments on Garnica-Ruvalcaba. Two indictments are for aggravated sexual assault of a child less than 14 and the other two are for sexual assault of a child less than 17. One of the aggravated sexual assault indictments holds two counts.
The first indictment alleges the aggravated sexual assault with a child less than 14 occurred on July 13, 2007. The second indictment alleges the aggravated sexual assault with a child less than 14 (2 counts) occurred on July 21, 2007. The third indictment alleges the sexual assault with a child less than 17 occurred on April 18, 2007. The fourth indictment alleges the sexual assault with a child less than 17 occurred on March 17, 2007. Busby said after the indictments were handed down, 36th District Judge Mike Welborn set four new bonds at $100,000 each.
Fermin Cruz Gutierrez, 30, an undocumented immigrant from Mexico, working and residing at a ranch near Whitsett, was also indicted. Gutierrez allegedly committed sexual assault on a child on June 24, 2007. Following an investigation by LOC Deputy Brad Whitworth, Gutierrez was arrested two days later, on June 26, said Busby. He was magistrated within 48 hours of his arrest by Judge Virginia Tanguma. The charges against him were explained, he was informed of his rights, and bond was set at $500,000. Gutierrez did not post bond and remained in the LOC jail.
On Oct. 15, the Grand Jury returned a six-count indictment on Gutierrez for aggravated sexual assault of a child less than 14. After the indictment was handed down, 36th District Judge Mike Welborn set a new bond at $250,000. Gutierrez remains in the LOC jail.

Why would bail even be set for someone accused of such a serious crime and no legal connection to the jurisdiction?
Even if these individuals were acquitted, they still need to be deported at the very least and they do need to be available for those proceedings.
Selective enforcement and non-enforcement of laws leads to a lack of respect for laws in general.
Illegals know that the government has a policy of ignoring immigration laws and laws regarding employment of illegals as much as possible.
Is there any surprise that illegals have no respect for our laws and culture?
The real responsibility for crimes committed against citizens is shared by the arrogant politicians in the White House and Congress and the employers and others that encourage, aid and abet illegals.
How much more ‘just doing the jobs the Americans won’t do’, will our administration allow to be perpetrated against our society by this invasion?

Let them loose on reduced bail. Retain their heads in the jail to ensure that the rest of their body shows up for trial.
