Obama irritated by Internet photo
BURLINGTON, Iowa (AP) -- Barack Obama complained on Wednesday about an Internet photo that claims the Democratic presidential candidate didn't hold his hand over his heart during the Pledge of Allegiance.
"This is so irritating," Obama said when asked about the photo in Muscatine, Iowa.
The photo, which has circulated widely on the Internet, was taken in September during Iowa Sen. Tom Harkin's annual Democratic fundraiser. A message accompanying the photo claims Obama didn't observe the pledge.
Obama said the photo was taken during the singing of the national anthem, not the pledge.
"My grandfather taught me how to say the Pledge of Allegiance when I was 2," Obama said, his annoyance obvious. "During the Pledge of Allegiance you put your hand over your heart. During the national anthem you sing."

Did he even sing? Hard to tell for sure in the youtube version, but it looks to me like he wasn't singing either. I don't mind him not singing, but I do mind him saying he was if he was not.

I see from looking in my handy copy of the United States Code Annotated that 36, section 301 a & b were revised in 1976 and 1998.
I wonder if this was what they changed?

As an American, Military personnel should salute the flag during the National Anthem, civilians should remove their hats and place their right hand over their heart.

It seems the answer lies in Public Law 99-344 which became law on July 7, 1976. It states in part:
“(18) by striking out section 6 and inserting in lieu therof the following: “SEC. 6. During rendition of the national anthem when the flag is displayed, all present except those in uniform should stand at attention facing the flag with the right hand over the heart....””
Hand over the heart was not required until 1976. Obama and others like me were taught hand over heart for pledge and no hand over heart for anthem. Obama, it seems, was just going with what he had been correctly taught many years ago.
Since then it is a requirement.

You’re right, he should know, especially being a senator, but frankly, I didn’t know it was a requirement until I did some research tonight. For many years now I’ve been thinking that all these people with hand over heart for anthem were doing it wrong.
So I learned something myself tonight.
