LAKEPORT, Calif. Three young black men break into a white man's home in rural Northern California. The homeowner shoots two of them to death but it's the surviving black man who is charged with murder.
In a case that has brought cries of racism from civil rights groups, Renato Hughes Jr., 22, was charged by prosecutors in this overwhelmingly white county under a rarely invoked legal doctrine that could make him responsible for the bloodshed.

Felony murder is commonly charged against the crooks in ANY criminal enterprise which ends in ANYBODY's death - including the death of a co-perpetrator. I'm in the legal community, and we see these charges as a matter of course whether it's the police or the intended victim or a fellow crook who brings the perp's life to a much-needed close.
For Fox or anybody else to be claiming this is somehow unusual is either stunning ignorance or equally stunning dishonesty.
The local community agitators are of course just reflexively playing the race card and couldn't care less what the law is.
Any deaths that occur during the commission of a crime are your fault.
Kidnap someone and they die of diabetes? Commit a burglary and your friends get shot up? You bear the guilt. Well known point of law. Get over it, NAACP shills.
That must come as a shock to every law professor in the United States, and residents of states such as Illinois that statutorily follow the Felony Murder Rule.

It was Associated Press. Fox just ran their story, but you're absolutely right. I see this type of prosecution all over the country according to news stories.

No...no....I just wanted to include some other comments on this. This is very important stuff and lots of folks don’t realize that this law exists in many sttes.
We’re about to use it here, in Minnesota, in a cop’s death....
He should be sentenced to life in prison, if not executed, for that alone.

I don't care if they were shot in the back. They had beat this man's stepson so badly he is now brain damaged for life. He is basically an invalid. If someone did this to one of my loved ones, I would't care if they were fleeing when I was finally able to retrieve my weapon. I would chase them down in my car if I had to!

The only racists in this story are the three black boys (hey, Amos, you called them boys, so I can too). They went into that house to kill some honkies and now two of them are six feet under. Too bad all three of them aren't. The only one I feel sorry for is the 19-yr-old stepson who was beaten so badly over the head with a baseball bat that he's practically a vegetable.

The remedy for this, of course, would be for ALL counties to prosecute this way. Maybe that would give some of these criminals (whatever color they are) a little pause.

With all that apparent hate and vitriol is it not incumbent upon the county Sheriffs department to immediately issue CCW permits to all adults residing in the house where the attempted burglary occurred?
Shouldn’t the local Police also visibly increase surveillance of the neighborhood to insure the safety of the shooters household.

The only thing the home owner did wrong, was to not kill the third criminal thug as well. If the situation was reversed, they’d have finished off the stepson, and killed the father and everyone else that was there.
