A 31-year-old east Coachella Valley resident was killed early Monday morning when he was shot in what Indio police are calling a home invasion attempt on Hamilton Court in Indian Palms Country Club in Indio.
He was shot by the owner of the home.
Genaro Chavez Munoz, 31, died of gunshot wounds at about 1:46 a.m. Monday at a home in the 82600 block of Hamilton Court, according to the Riverside County Sheriff's Department coroner.
Police found the body lying partially in the front window of the residence.
Police say Munoz was from Indio, his family say he lived in Coachella.
Family members of Munoz also say he was not attempting to burglarize the home and had instead gone over to the home with two of his cousins to retrieve some money that was owed to him.
Police however, said Munoz was killed by the owner of the house he was breaking into.
According to police, the homeowner was awakened by Munoz when he entered the home at about 1:30 a.m.
The two men struggled and the suspect shot the homeowner in the foot.
The homeowner grabbed the weapon from Munoz and fired several rounds, killing the suspect, according to police.
Lucina Munoz, Genaro's sister, doesn't believe that is what happened. She believes the homeowner had his own weapon.
Police are not releasing the name of the homeowner. He was treated at John F. Kennedy Memorial Hospital.
The incident is under investigation.

"As an Indian Palms homeowner I applaud my neighbor for being a man in protecting himself and his. Except for the injuries sustained by the innocent party, the incident had a satisfactory outcome. The ideal closure would be for deceased's accomplices to be charged for attempted HOME INVASION ROBBERY and murder."

Ahhh... sorry... going over to “retrieve some money” at “1:30am” via the “front window” does not sound like a typical way to conduct an honorable business transaction. This was attempted robbery - pure and simple.
“Eh, pardon me, sir, but could you direct me to the shortest route to the Coachella Valley and the big carrot festival therein?”

Self defense. The invader came in with a gun and demanding money and had used the gun in the demand.
Take it to small claims court if you want money. Don’t take a gun to someone’s home, break in, and demand they give you money.
Oh, and with a LOADED GUN IN HIS HAND.
Come on now, who among us hasn’t gone to retrieve a debt at 1:30 a.m. and used the front window?
And the sister “doesn’t believe” the homeowner’s version of events...when will relatives of perps learn to just keep their mouths shut and avoid looking foolish? Who cares whose weapon it was? Your brother was somewhere he shouldn’t have been and apparently paid a dear price for his trespass.
The family of the victim forgot to mention that the money was "owed" because the homeowner had some, and the victim did not.

I’m tired of reading about dead “suspects” caught in the act. There are no trials for the dead. No convictions either.
You cannot defame the dead. He doesn’t need to be called a “suspect”.

I find it amusing that an individual can eat a load of double-o buck in the face as he crawls through a window with a knife and be referred to as an “alleged burglar” or “suspect”.
As a California resident I applaud the homeowner for defending himself, taking a dangerous thug off the street, and saving me the cost of prosecuting the thug and paying for his imprisonment.

When will these idiots get it? To break into another person’s home, is tantamount to threatening them with intent to kill.
I’m am very happy to see, more and more, homeowners taking their safety seriously and as a personal responsibility.
Indo and Coachella are towns in the California desert, east of Palm Springs...
but if the perp had a “smart gun” the homeowner would not have been able to take the gun and use it against the home invader.
The real question is: What the heck is a XOCHITL?

So what? Her brother had a gun. He was breaking into the man's house at 1:30 a.m. with a gun. Regardless of whose gun ended up shooting the invader, he got what he deserved. And I have to wonder just how long that family has lived in Indio.
LOL... OJ gives our society such a great way to address the problems we have with life.

I would love to see this defense raised in a court of law; “I only broke in to retrieve what I am owed.” Problem is it might work with some jurors.

Of course you are right. Whenever I break someone’s front window to collect payment on a debt at 1:30 AM, I also make sure to carry a loaded gun. It’s just common sense, really. :)
