Just abandon your hidden position, leave the spotter behind to be sure no one takes the sandwiches, stroll down to the river, and detain a half dozen people with automatic rifles.
(Better yet - take your very expensive, .50 cal, sniper rifle and a government approved phrase book with you so you will have something in common to talk about)

Your post is an important one. I back the President and Gen Petraeus. Ending the day with fewer enemies than you started with is crucial to counterinsurgency.
But there are unintended consequences. Destroying the lives of Marines and Soldiers through prosecutions intended to win hearts and minds of Iraqis being one of them.

I know what this is about. I recently saw a news clip about how the Marines are going back into Fallujah, but that this time they were to "extend arms in a handshake, not bulletts"
The whole piece was about a new approach, a PEACEful approach, and I had to pick my jaw up a few times.
I didn't find the clip, but I found this from the mnfUBAR site;

They're sending the 3/5 back into Fallujah with little but their dicks in their hands.

Solution: Every Marine should be provided with an attorney to place between himself and hostiles, to preapprove his actions so he will not be court martialed. This would also be good for society in general.

Why not just say this: In any scenario where there appears to be an imminent threat, just run away.Safest thing to do, for if you survive you will be court martialed.
