The Kansas Supreme Court has stalled a Wichita grand jury's subpoena of abortion records from the Kansas Attorney General's Office.
By an order this afternoon, the high court said the attorney general's concerns over patient privacy were similar to the issues raised by lawyers for Wichita abortion provider George Tiller.
The grand jury, convened by a citizen petition driven by anti-abortion groups, has tried twice to get a look at abortion records.
First, the grand jury tried to order Tiller to turn over 2,000 patient records of women who tried to seek an abortion at the Wichita clinic at least 22 weeks into their pregnancy.
The Supreme Court postponed enforcing the subpoena until after it considered arguments by Tiller's attorney that it would violate the privacy rights of his patients and that the grand jury was unconstitutional.
The grand jury then subpoenaed records from the Attorney General's Office that were obtained when Phill Kline held office.
Current Attorney General Stephen Six then appealed to the state's highest court.

Action must be taken to preserve the integrity of potentially incriminating abortion records.
Wichita, KS - A large Penske box truck arrived at Women's Health Care Services on Monday, February 18, 2008, and was loaded with several boxes that appeared to contain documents, according to eye-witness Margaret Weaver, who was monitoring the late-term abortion mill. The clinic was not open to patients at the time, and no other vehicles came in or out of the parking lot.
What made the incident more suspicious was that the truck's license plate had been removed.
"Trucks of this nature are often leased to businesses," said Operation Rescue President Troy Newman. "But driving a motor vehicle without a license plate is illegal. No legitimate business would operate like that. Something is obviously going on there that Tiller and his secret collaborator do not want anyone to know about."
What makes yesterday's incident even more suspect is the fact that currently Tiller is resisting subpoenas from a grand jury that has requested 2,000 abortion records, with patient identifying information redacted, in their investigation of illegal late term abortions. The Kansas Supreme Court issued a stay until briefs can be filed. A ruling from the Court on the release of the records to the grand jury is expected after February 25.
"Something must be done to preserve the integrity of those records until the court rules," said Newman. "We already know that Planned Parenthood falsified records submitted to a judge in another Kansas abortion investigation. We also documented shredding trucks at Tiller's destroying documents just days before a Supreme Court ruling on a different records request. Tiller cannot be trusted. From past performance, it is obvious that he will stop at nothing to avoid having to hand over accurate abortion records that could land him in prison, and that includes altering, moving or destroying incriminating evidence."

The solution is simple.....obscure/delete all references to the name of the “patient”,her address,place of employment,etc.Assign each one a number...”Patient #221”....”Patient #47”,etc.

Topeka, KS - A subpoena issued by a citizen-called grand jury for abortion records in the custody of Attorney General Steve Six has been stayed by Kansas Supreme Court Chief Justice Kay McFarland.
The subpoena asked for 60 abortion records that were obtained by former Attorney General Phill Kline in 2006, which have already had all patient identifying information redacted, and have been certified for release by the Supreme Court to investigative agencies of the Executive Branch.
Some of those records are the basis for 19 criminal charges of illegal late-term abortions that Tiller currently faces. The grand jury is investigating Tiller on allegations of having committed illegal abortions on viable babies over a five-year period.
In staying the subpoena, the Supreme Court said that Six's motion cited similar privacy concerns put forth by Tiller's attorneys, who earlier moved to block 3 grand jury subpoenas for 2,000 of Tiller's late-term abortion records.
It’s hard to find other states pursuing abortion mills with equal intensity.
Yes, the pursuit is being obstructed by Democrats in the Executive Branch and AG office, but the pursuit has been ongoing for quite a while.
Many other states leave the fight to not for profit agencies.

Former AG Knew Planned Parenthood Records Were Falsified Before "Clearing" Them
Olathe, Kansas - A brief and supporting documents filed in Johnson County District Court yesterday show proof that former Attorney General Paul Morrison had knowledge that Planned Parenthood had falsified abortion records prior to issuing a letter to the abortion group exonerating them of any wrong-doing last year. The brief also shows that concerns for patient privacy, which Morrison repeatedly floated in the media, were entirely without basis in fact.
The documents indicate that the Attorney General's office was involved in a scheme to suppress Planned Parenthood criminality and block any criminal prosecution.
The brief said that Judge Richard Anderson, who oversaw the redaction of abortion records in a previous abortion investigation, "was stunned that General Morrison would issue a clearance letter despite clear reason to be concerned about the authenticity of the documents produced" by Planned Parenthood. (Pages 30-31)
The court brief and attachments filed by District Attorney Phill Kline, are in response to a motion by Planned Parenthood to quash subpoenas issued by a Johnson County grand jury that is investigating them for illegal late abortions, the concealment of child rape, and other crimes.
Kline is asking for the grand jury to be extended in light of Planned Parenthood's refusal to comply with the subpoenas for critical evidence.
The brief states that:
Judge Richard Anderson already certified that the records subject to the subpoenas had all identifying information removed, and that it "is not possible to identify any patient by reviewing the records." (Pages 54-56)
Planned Parenthood's own website indicated that their concern for "privacy" was so minimal that they routinely referred patient names and medical information to fundraisers for the purpose of extracting donations. (Pages 70-73)
Morrison repeatedly lied to the public about the security the records, indicating that he had to go on a 7-week "scavenger hunt" in order to locate all the copies.
Those statements are completely contrary to a Kansas Bureau of Investigation report that indicates every record was exactly where the status report indicated that they would be. The KBI records indicate that all copies of the records were quickly accounted for. (Pages 62-67)
Morrison lied in a threatening "cease and desist" letter to Dr. Paul McHugh about having notified the psychiatry expert that he was still a witness in a potential case against George Tiller. (Pages 68-69)
Morrison resigned amid a sex scandal wherein he attempted to use his illicit lover to spy on Kline and his abortion investigations for the purpose of thwarting prosecutions.
"Planned Parenthood is playing a game of delay, hoping that the clock will run out on the grand jury. They are used to having the corrupt protection of former Attorney General Morrison, and are hoping that Attorney General Six will also jump into their back pocket," said Operation Rescue President Troy Newman.
Attorney General Stephen Six has come under fire for resisting a subpoena in another grand jury investigation of George R. Tiller. Six was granted a stay on the subpoena after he argued that privacy rights were a concern, even though the requested records also contained no possible way to identify patients. His arguments have given the impression that he is following in Morrison's footsteps.
"Given the corruption under Morrison and the appearance of impropriety by Six, there is a real urgency that the grand jury be allowed to access evidence and be given adequate time to conclude their investigation," said Newman. "Anything less must be viewed as obstruction of justice and evidence of corruption at the highest levels."
