A brief status conference was held this morning in chambers with Superior Court judge Aurelio Munoz to discuss Paul v Clinton. Although a trial date was not set as expected, the door has been opened for discovery.
Peter does not expect that a trial date will be set for this year, but the key was to begin discovery and start the depositions. It is time to get these people under oath. The discovery was put on hold while Peter pursued his appeals to bring back Hillary to join her defendant husband.
David Kendall made it absolutely clear that he will not cooperate in any way in the service of process on Hillary. The likely time for her to testify is between Aug. 8, when Congress begins summer recess, and Aug. 25, the DNC nuclear food fight convention in Denver.
One of the defendants, James H. Levin, needs to be served in the next 30 days. He is in Chicago and is currently under probation after a plea deal with the US Attorney's office. Unless someone associated with the Clintons has plans for Levin to sleep with the fishes, Levin should be able to be served without a great deal of trouble.
Levin is a critical part of Peter's case. He is the one who flew to Japan and seduced Stan Lee Media's business partner, Tendo Oto. Despite signing a non-circ agreement, Levin used proprietary business information to steal Oto and record his own deal with him. That partnership was recorded in Illinois just six days after Hillary was elected.
Levin was an agent for both of the Clintons. The law of agency makes the Clintons responsible for his acts.
What will Hillary do to avoid service? Have the Secret Service rough up or shoot anyone who gets near her? As someone who is trying to become the chief law enforcement officer of this nation, shouldn't she cooperate, rather than attempt to obstruct justice?
Any opinions from FReeper lawyers on this thread will be appreciated. Hillary can be served and told to report to a deposition while Congress is in session. The problem is that no court sanction can be enforced against her while Congress is in session. They cannot arrest her for failure to obey a court order.
Much of this case was damaged do to the incompetence of Peter's previous counsel, Judicial Watch. Tom Fitton has refused to make a settlement with Peter regarding the many millions of dollars collected from donors for Peter's case. They did not spend the money on his case. If any of you are still donating to them, you should have the word SUCKER branded on your forehead.
Another status conference will be at the end of March to set the trial date. Within approximately 70 days of today's date, David Kendall will make a motion for summary judgment in an effort to kill the case and keep Hillary from ever testifying. Peter doesn't see the judge doing that because there is real evidence in the case of business fraud and tortious interference.
A moment of levity occured in the hallway after the status conference. Kendall told Peter's counsel, Colette Wilson, that he is going to ask for attorney fees. Colette's response was, "Get in line behind Fidel Castro." The judgment against Peter in favor of the Cuban government for the Cuban Coffee Caper is now over $100 million dollars with accrued interest. Peter plans to give a check to for Fidel's coffin when the murdering dictator finally leaves his earthly bonds.

The Clintons have no problem with lying under oath. Why does anyone think this will be any different?
Peter will be announcing a fundraising plan for litigation costs. He is considering a legal trust in which people could make small donations to own a piece of the judgment he hopes to win. None of the big GOP donors have been of any help in this effort. Talk show hosts on our side have not been of any help publicizing this case. It seems to be that it should be somewhat newsworthy that the door has been opened for depositions of Bill, Hillary, Chelsea, Gore, Rendell, McAuliffe, Wolfson, Craighead, Cher, Streisand, etc. Chelsea’s deposition should be particularly interesting because Hillary’s lying declaration has set her up to commit perjury to protect her mom.
Peter has unique evidence in this case, including several hours of candid home video with Hillary.

Hillary denied under oath knowing anything about the business arrangement. There are witnesses from the day after the Gala at a Streisand event. Chelsea said, in front of those witnesses, how the family stayed up late playing Scrabble and discussing how excited they were that dad was going to work for the man who created Spider Man.

She doesn’t have to be served in California does she? She’ll probably discontinue all glad-handing opportunities. Maybe if the server had a couple of C-notes stuck to the paperwork in full view of the perp.

I think it takes 20 days notice. It shouldn’t be long before we see some of the players in Los Angeles under oath.
