Honored detective suspended without pay (hero alert)

Detective Dennis A. Delano, an outspoken member of the Buffalo Police Cold Case Squad, faces departmental charges and has been suspended without pay, the police commissioner announced this afternoon.

Commissioner H. McCarthy Gipson has charged Delano with defying orders from his superiors and with releasing a videotape and other investigative materials without authorization, Gipson said in a statement.

This is the latest episode of another failed murder investigation of a 13 year old girl in which an inncocent woman spent years in prison for the murder of her 13 year old daughter.

Unanswered questions about Crystallynn Girard Something terrible happened in the bedroom of Crystallynn Girard 15 years ago, and we may never know what that terrible thing was.

The 13-year-old girl was found dead on Valentine's Day 1993 at 2 p.m. She was naked except for a pair of socks.

A medical examiner at the time said she had been strangled. A jury said it was at the hands of her mother, Lynn DeJac.

But in November last year, the conviction was set aside and a retrial was ordered after DNA found at the scene indicated that DeJac's former boyfriend, Dennis Donohue, had been intimate with Crystallynn and in her bed.

But when two pathologists re-examined the autopsy results, they came to the conclusion that Crystallynn wasn't murdered and that she had died of a cocaine overdose.

The finding raises many troubling questions.

How did Crystallynn get cocaine?

Did she take it voluntarily?

Did it really kill her?

Or was she strangled, or is there yet another explanation for her death?

How did Donohue's DNA get into her bed?

What did he do to her?

But with the charges being dropped against DeJac, it doesn't appear that any of these questions will ever be answered.

Det. Delano is something of a local hero, but he mismanaged the DeJac case as badly as anyone. Leaking investigative materials to the media endangers the case. It might have made it harder to exonerate DeJac

Delano deserves kudos for his tenacity in freeing Capozzi - but that doesn't give him a free pass to insubordination.

That is not who it went down. The tapes were not leaked by the detective and leaking the tapes happened after the findings of Dr. Baden who “found” that the little girl died of a cocaine overdose. Yeah...sure

Since when is evidence is selected to fit a predetermined verdict? I guess in Buffalo, NY it’s when the political powers cover up the truth.

That's not what your own source says.

Delano is accused of defying repeated orders from his superiors and of releasing to WGRZ-TV, Channel 2, a videotape from the Lynn DeJac murder case and other investigative materials without authorization. The station ran a package Monday that featured the videos, which continued to be available to its Web site viewers this week.

“This is the property of the Buffalo Police Department,” Gipson said of the video evidence. “If the confidentiality can’t be protected by the [department], I’m responsible for that. If I let it go on, what’s to stop the next guy from doing it?”

Added Gipson: “The charges against Mr. Delano are extremely serious in nature, and his actions have compromised the integrity of the Buffalo Police Department.”

My source? no.

That is what the Delano is being accused of.

You know the difference?

But you know even if he did get those tapes in public, those tapes lead us to the truth..the truth about a massive coverup in the DA’s office as well as the PD.

Was the video tape used at the trial?
If so was it shown to the jury?
If there was blood everywhere how come the prosecutor said she was strangled?
The video tape shows the room torn up. What kind of fight was going on?
Where did the blood come from?
If the video tape was part of the evidence why was it not a matter of public record after the trial?
If the video tape was not used what was the prosecutor hiding?

All those questions have not been answered..but instead they suspend the cold case guy who is trying to find the truth about this little girl.

The corruption in this area astounds in its blatant power.

According the the Erie County District Attorney, Frank Clark, the person in charge of prosecuting the case, has said that the case was closed, and he dismissed all charges against Lynn DeJac. They are now ruling the cause of death as an overdose. If the case is closed, and the victim’s family has no problem, which they don’t, the police have absolutely no reason for restricting the release of that material.

Somebody doesn’t want the truth to come out and they are punishing Delano for trying to get to the truth.

No telling how many times the victims kin is put in jail for the crime just because the police want a quick closure to the case and don’t really care who done it. The Peterson guy in Ill. is suspected of killing 1 or more of his wives. But if he is totally innocent the police will be perfectly happy to send him up. By any means.

Pre-trial publicity could preclude its admission in a future proceeding against another accused, or even bar the prosecution of the very person Delano thinks committed the crime.

Delano was just on WBEN with my friend Kathy.

Delano contends the case was closed, I pretty much agree with that as those are the words of Clark.

I think there are a few things going on here,
1-Donahue was given immunity and is the real guilty one.
2-they moved to quickly on this case by painting her a bad mother and to just chalk up another conviction for the DA.
3-covering their tracks giving immunity knowing he was the real killer.
4-corruption as we all know runs rampant in Buffalo, the cover up will do more damage than the anything else.

Bad mistake and poorly handled by the whole department and Clarks office. Let them say what they will, Delano did the right thing IMHO.

A innocent woman is free, thank God for that.

Yeah...corruption in places like Buffalo, Detroit, Hartford, Philly...etc etc have to be terrible; not that the MSM would notice. They’re too busy still chasing Rove.

I think this will be the killing blow for Clark even though it may not be all his fault. I really smell something rotten in Denmark and I think focusing just on Clark is what the powers that be want us to do.

I personally think that Clark wanted to find a way to drop all the charges on DeJac and end this case completely. He had to, it could not be left an open case is it was. But the way it was handled was just piss poor. Now everyone is looking at this case, everyone nation wide.

Another black eye for Buffalo.

I want to know WHO is behind this and hopefully someone will have the wherewithal to persue it besides Delano, he in my opinion is being made example of. H McCarthy Gibson, Byron Brown and others need to be exposed for what they are but right now they are all in Ohio campaigning for Hillary.

I just heard this morning that Det Delano did take out the video tapes but he did so after he was told to stop investigating.

IMO - he did the right thing by releasing this information. The good old boys in this area have had a free pass on doing what they want —and that is a mess!

Go Dalano! There is a higher law and that is getting at the truth.
