Catholic hospital to allow transgender surgery after being sued

Daly City, CA, Mar 4, 2008 / 04:19 am (CNA).- A Catholic hospital that refused to allow its facilities to be used for breast implant surgery on a man that had undergone a sex-change operation will now allow the procedure, the California Catholic Daily reports.

In 2006 a doctor told Charlene Hastings, 57, that Seton Medical Center in Daly City would not allow him to perform breast-enhancement surgery on a transsexual.  Hastings claimed that upon further inquiry a surgical coordinator at the hospital said to him, “It’s not God’s will” and “God made you a man.”

A 2006 memo sent by Seton Medical Center to physicians said, “transgender procedures or procedures that are part of the transgendering process may not be performed at Seton, as Seton is a Catholic Hospital.”

Hastings filed suit against the hospital in San Francisco Superior Court in December.  The suit alleged that Seton violated state law, which allows religiously-based hospitals to refuse to perform abortions but makes no exemption for denying elective surgery for transgender operations.

On February 27 the San Francisco television station CBS 5 News reported that the hospital had issued a written statement to CBS 5 that said, “We regret any confusion that may have come from this situation. We want this patient and her physician to know that they are welcome at Seton Medical Center.” 

The hospital still said that Catholic teaching prohibits the accommodation of sex-change operations.

The CBS 5 News station characterized the statement as a “veiled apology.”  It said, “transgender Charlene Hastings has claimed moral victory against Catholics.” 

According to the California Catholic Daily, Hasting’s attorney, Chris Dolan, said that a lawsuit seeking monetary damages would proceed.

“Like any good religious experience, first you need enlightenment and then you need atonement,” said Dolan. “And what we have here perhaps is a glimpse of enlightenment. Has it changed their heart? I don’t think so. Will it change their practice? It better.”

Hastings will not undergo surgery at Seton, saying he would not be comfortable because he would feel the hospital would be “doing it under duress.”

But the hospital is giving in and accommodating sex-change operations anyway? Have they decided that God makes mistakes, and that the crazy homosexual guy who wants breast implants actually knows better than God? Is that the position they're taking?

Perhaps they meant operations involving the primary sexual organs. Maybe breast implants alone don't meet the definition of "sex change."

Why do I get the feeling that this whole thing was a set-up...especially now that Hasting is not going to have the surgery done there.

if it were a Muslim Hospital (do they have hospitals, or do they just strap bombs on to the sick and retarded and use them as weapons?) the question would have been over...and they would not dare question the tenants of their ‘faith’.

I’m disgusted that this hospital caved. They are still going to get sued (which is probably why they caved in the first place), so what was the point of compromising their moral stance?

In other words, this is now a former Catholic hospital.

Mother Seton is content in heaven, knowing that the God at whose throne she offers eternal praise will vindicate her name in His time.

I would not want to be Chris Dolan on the Last Day.

The article is written in a very confusing way. The she-man's not getting the breast enhancement there anyway, and the hospital says it's prohibited "welcome" to come there. For what? Counseling?

Was there not another hospital in this area that this queer could have gone to, to mutilate his body? I mean come on, why THIS hospital??? I am more than positive that he could have gone elsewhere. Am I wrong in my thinking that this was an attack on those "queer hating Catholics" (yea right) just to make the hospital do this. Does the hospital, as a religious institution not have rights? The hospital has a choice - give in or give up (i.e.: close). To stay open, they must comply with the legal decision.

I do not get the sense that the hospital has changed its mind, or that they believe God makes mistakes, but rather they acknowledge that man’s courts do make mistakes, and this mistake is something they have to live with if they are to continue operating at all.

What happened obviously is that the hospital was sued into allowing breast implants, but still rejects doing "sex changes," at least until the next sodomite sues them into doing those, too.

So business can't deny to perform certain actions based on management's decisions?

Does this mean I can sue if the local pizza house refuses to make sushi for me?

Or how about suing the hardware store for not providing a tanning booth?

It’s quite simple. Good is bad; bad is good.
There are moral principles but on the other hand, a hospital is a business. That’s why they caved, but all this can do is demoralize them, especially with the impending lawsuit.

Well, come on. It's a procedure which violates Catholic teachings, no different than abortion. Though it's not spelled out in the law, it would certainly fall under the umbrella.

Fine. I predict that within one year, it WILL be codified into law. And people say, "Why do we have so many laws?"

Why? Because of 57-year-old, hedonistic, transgendered, cross-dressing transvestites like these who intentionally force their perversion on institutions they KNOW will object.

Plastic surgery. Behold the parsing of legal and medical regulations per the hospital and critics.

Problem, they aren’t the only ones ‘living with it’, this is about the faith of millions and a long period of scripture and church teachings. It seems they have decided thus, so it’s time to remove the Catholic label.

Or they need to close. While they’re at it, they can pull their adoption agencies, pantries, refuse state funding of any kind in Catholic schools and dismiss voucher holding students.

Who the heck do these clowns think started schools, universities, hospitals, charities in this country? The religious.

Now if they want state to be the religion of the people, let them carry it.

If it were a muslim hospital, school, charity, pharmacy, etc., would we hear this?

The irony here is too much.

This poor soul can add whatever body parts he wants, sue whoever he wants. Genetically, he's a man and always will be. And doctors who mutilate people with mental illnesses like this aren't helping anyone get well.
