Va. targets adults who French kiss kids

RICHMOND, Va. - State legislators passed a law Saturday that would require adults who French kiss a child younger than 13 to register as a sex offender.
Those convicted of tongue-kissing a child would be guilty of a misdemeanor, punishable by up to one year in jail and a $2,500 fine. The House of Delegates passed the legislation 96-1 and the Senate 39-0.
The bill now heads to Gov. Timothy M. Kaine, who said he supports the legislation.
Delagate Riley Ingram, R-Hopewell, introduced the bill on behalf of a woman whose 10-year-old daughter was French-kissed by the 62-year-old husband of her babysitter.
The only crime prosecutors could charge the man with was contributing to the delinquency of a minor, which did not require that he register as a sex offender.
Ingram and other members of the House fought to make the crime a felony, but in the final day of the 2008 General Assembly session gave in to senators who thought that classifying it as a felony was too harsh.
Delegate Phillip Hamilton, R-Newport News, cast the lone nay vote, refusing to back down from his belief that the crime should be a felony.
"I think that type of behavior is so egregious it warrants a felony," Hamilton said.
Ingram said he was satisfied that a conviction would land someone on the sex offender registry.
No kidding.

If a 62 year old tongue kissed my 10 year old daughter, I would have named the bill after him, held a press conference with a poster sized picture of him in the background and called him in to testify at legislative hearings.
Perhaps a catch-all law permitting the father to beat the crap out of such persons (and others) would do the job.

If the parents found out weeks later that he forced her to perform oral sex, it would be his word against hers. There would be no concrete evidence.
This is the kind of legislation that should never be proposed for the simple reason that its unopposible once it is.

There’s no such thing as a ‘french kissing kit’. A molestation charge is brought, a gyno check would reveal vaginal stretching. The lack of any physical evidence of sexual molestation is defense #1 for any Father who didnt actually do it.
Also, it’s still fairly difficult to convince a kid that Dad put his fingers (or anything else) where they’ve never actually been. But Father’s do kiss there children, convincing a confused kid that the kiss went ‘over the line’, or whatever, would be pretty easy.
This? Mom’s word against Dad’s. Mom saw it. She swears he did it. The kid’s denials are irrelevant, Mom’s lawyer simply argues the kid dosent want to seperated from the Father or see him punished even though he really did do it, Mom swears he did.
I hope Va Father’s knew this vote was in the offing. Your last chance to kiss your kids goodnight has already passed.
I guess no matter what it is you need some solid proof. No way should one accusation, a conviction make — especially for a criminal charge with such large consequences.

One of the basics in investigating an oral sex allegation when it comes to a child is holding up compounds to their nose. If a child can properly ID the semen-like smell, the prosecution can establish the child, at minimum, has injested either ejaculate or at least pre-ejaculate.
Tongue? Saliva? Kid’s already got those.

I was french kissed at the ripe age of 10 by a 50 something pervert.
No rape, and he didn’t have the opportunity to do much more damage other than get a bit grabby before a friend helped me get away from him.
He went on to do much worse things to other kids.
Anyone who would do this to a kid is definitely a pervert and a sex offender.
Many kids get molested without getting raped, and all we have is the kids word (and usually confirming testimony from other victims as well - they rarely target only one child)
This should fall under the category of molestation.

The little girl was a complete emotional wreck. Many times she would throw a epic tantrum when her mother would leave to come to work. At two years old she had therapists working with her. The fits were so bad that her mother would have to bring the little girl to work with her, which I allowed. At work she would fly into uncontrollable rages, screaming and crying.
When she threw her fits I would pick her up and talk to her and eventually she would calm down. We soon discovered that if I let her sit in my office she would sit or play quietly all day. My office was on the hectic side with people in and out all day and the telephone constantly ringing but she would be perfectly calm through it all. No one could figure why.
On her third birthday I had forgotten to get a gift so I picked one up after work and swung by their house which was only a couple of blocks. They were having a little party so I sat down for a few minutes. When I gave the little gift her mother told her to give me a kiss. I expected a little peck on the cheek but she crawled up in my lap and stuck her tongue down my throat.
In one instant everything became absolutely clear. I looked at the scumbag brother and he ran out of the room. That little girl was being regularly molested and that was the cause of all the behavior problems. I was the only one that she felt safe with. I had a long talk with the therapist and backed out of that one quick.

The duke lacrosse case showed us there are still jerks who lie about getting raped.

What concerns me is the way the legislators are motivated by making political statements by writing laws without concern for where they lead us.

Honestly, I really wish we wouldn't have to legislate to this level of detail. It should be a given that you don't do ANY of that with MINORS.
I don't know. I'm usually pretty extreme when it comes to civil liberties and the like (at least by Freeper standards). Heck, I even find myself on the same side as the ACLU from time to time. But I think a felony classification is appropriate here.
French-kissing is not an act a person might do inadvertently, like trying to push a kid on a swing and accidentally touching his backside. Nor does the seriousness of the act change depending on context, like a pat on the butt at a football game vs. on the ride home. I think almost every reasonably adult would see French kissing as unambiguously sexual. As such, it should be treated like any other sexual contact with a child.
Now this all assumes that one has in fact French kissed a child. Like others on this thread, I think this law could is susceptible to abuse or misuse. But that's a different matter. If a prosecutor can prove beyond a reasonable doubt that an adult has French kissed a child (say, by a confession or some other reliable evidence), I think it's appropriate to treat the matter as a felony.

This is the craziest redundant idea...are they saying someone who gets caught doing so, isn’t already one, and shouldn’t be put on the list? Oh wait, I forgot...they can PLEA DOWN. Since we can’t seem to stop THAT INJUSTICE, I guess this is the next best thing??? I say, upon conviction, ALL predatory sex offenders should be put on the list, whether they PLEA DOWN or not.
