Judge stops deportation proceedings against Danbury family[CT][Exceptional hardship]

A federal judge ruled in favor of the defendant and has stopped deportation proceedings against a Danbury family.

The judge said that deporting Tereza Pereira and Carlos Lima would result in an exceptional hardship on their two American-born sons, one of which is an honor student at Danbury High School.

"Thank God it's over, now we can return to peace," Pereira said immediately after the decision.

About a dozen supporters of Pereira and Lima were in the court room. The room erupted in cheers when the judge ruled in favor of the defendant.

They are expected to receive their green cards within the next few weeks

This is one of those no easy answer situations. The kids (American citizens) have been here a long time and since they are citizens what do you do, send them packing with their parents? Our laws say that minors cannot live on their own until they reach a certain age so in the end, do we kick American citizens out of their own country just so we can get rid of an illegal?

It would seem that the judge has set a precedent that can now be used by others with similar circumstances.

they can go back with their parents or can stay and go into foster care, if people break laws there should be consequences, if I robbed a bank and got caught, putting me in jail would be a hardship for my family. should I go free then??

What typically happens when a parent or parents of a us citizen commit crimes and goes to prison? Who takes care of those children?

The state right? Or next of kin relative?

They committed crimes and should be deported. The children have the option of moving and living with their next of kin or being taken care of by the state.

Their citizenship came as a result of an illegal act by their parents. More to the point, the kids are teenagers. Surely the parents can find some legal resident to be their legal guardians for a year or two?

Exactly! It is like saying turn you loose because robbing does not hold up as a crime in the face of hardship on the children. Send them back and let the children stay in foster care or go back.

I agree it is time to stop this citizenship farce if a baby is born of a mother who came across illegally just to have a baby here, or came illegally and subsequently had a baby here.

If a child is born of a legal immigrant, baby is a citizen.

The implications and circumstances are never ending. I am tired of this.

Letting folks use their reproductive organs as a free pass in
violating the law of the land.

Different issues.

How do we protect the citizens while removing the illegals? Maybe there is a family that they can stay with until they are able to live on their own but in the case of younger kids do we force them into a foster care situation with all of the horrors that government social programs can create? All we are doing in those cases are continuing to expand government and throw citizens under the bus.

You have to change the rules on automatic citizenship in order to stop the practice of anchor babies.

another thing that really pisses me off is when we hear how much financial hardship there is and how there are fewer jobs but we have 20 million people in this country that are taking jobs and not entitled to work here, these a-holes want it both ways

The "anchor baby" farce needs to addressed during any discussion further discussion of "immigration reform." What is going on right now is a joke.

The best example of this farce occurred about a year ago when an airliner from Central America allowed a woman to fly who was about to give birth. According to the crew, the woman gave birth shortly after the plane entered American airspace. The plane hadn't even landed on American soil when the child was born. The family demanded that the baby be granted American citizenship and that the family be allowed to stay in the US. That my FRiends is BS.

Their citizenship comes from our laws as written. You are going down a dangerous path that opens all sorts of doors to deny citizens other rights by trying to qualify how they got them or how easily they can be denied their rights as citizens.

The law is the law. Send ‘em all back. Once the kids are 18 they can always return. Or the oldest can apply for legal emancipation now before mom and pop are deported.

How about banning the very idea of anchor babies.

Problem solved.

These people broke the law and unfortunately their children may have to pay the price. They can always blame their parents for failing to enter legally.

Boo Hoo. Cry me a river over these illegals. I noticed two different last names, too. Their kids are ILLEGITIMATE.

Don’t complain when your rights as a citizen are infringed upon then. You could give a rat’s ass about these kid’s rights as citizens so your complaining in the future about gun grabbing, free speech restrictions or anything else that violates your rights is moot.

At the very least, the judge should have made them pay all the legal fees this couple cost the CT taxpayers, as well as making them pay all the income taxes and Social Security taxes they owe this country. There should be no “Get out of Jail Free” cards dealt by bleeding-heart judges, who thus encourage others to break our laws. How many judges do we have in this country who rule on the basis of personal prejudice instead of upholding the laws as their oath requires?

There’s nothing wrong with sending the kids back with the parents. The parents broke the law and the kids should have to pay just like real American kids have to pay when their parents break the law.

Frankly, I could care less about the kids. They’re not adults yet, and don’t vote.

The answer is a very easy one. The same answer has been delivered to the sons of criminals as long as there has been crime.

As I recall the Bible says the sins of the fathers are visited upon the sons.

When parents commit crimes their children also suffer. There is no way around it if we are to live in a lawful society.

The parents must be deported and the children either suffer the absence of their parents or leave with them and suffer the consequence of living in what ever country their parents come from.

The kids are NOT US citizens by all reviews of the law BUT CONVIENCE and legal cowardice allows the Feds to avoid pushing that “understanding” because BUSH wants it that way.
So, yes the kids have to be deported with their parents because all four of them are illegals.

Abobora, The funniest thing happened to me yesterday. I was at the bus stop in danbury searching for work and this **** picked me up on his truck. He needed someone to paint his garage. When I got to his house in new milford I asked to use his bathroom and he pointed to the woods. I got so mad that I took the biggest **** in the woods and brought back a turd and put it inside of an old shoe that was in his garage. The fool paid me $200 cash.

Maria Gomez, Awsome! That great to hear that **** I have a similar story one of the house’s i clean on a weekly basis. The home owner doesn’t like me to use her bathroom. So I started taking this tea to lose weight and it gives me the sliders. On her schedule day I noticed she was not home so I took a double dose of the tea and crapped all over her toilet seat. On top of that I drank an entire bottle of Patron she had on her bar. Any other immigrants got funny stories? I would love to hear.

There is NO law as regards “anchor babies” BUT there is just some vague custom that has never been legally acted upon by the SCOTUS in that matter. Hence what we have here is a legal decision without being a law to decide from.
The is NO ANCHOR BABY PROGRAM. Never has been but the practice has been “allowed” but that does not make it law.

A patriot legal group now has the opening to challenge this judge’s ruling and thereby get this “anchor baby” BS front and center. Let the fight begin !!

Bush has nothing to do with this. It’s been this way for a long time. I don’t agree with anchor babies being given status but if it has been the accepted standard then until a law is passed to change it then it stands. Can’t go back and tell someone that they are not considered citizens if they have already been recognized as such.

I was born here. My parents, grandparents, great-grandparents, and great-great-grandparents were all born here.

That ain’t gonna happen.

But you go ahead and make your decision based solely on the emotional sensationalism of “but their poor widdle kiddies” when we nab some criminals....and that’s what ALL illegals are, CRIMINALS.

I was taught by the nuns that you punish criminals, not reward them and coddle them.
