Senator: Let's monitor P2P for illegal files

WASHINGTON--A prominent Senate Democrat on Wednesday said federal and local police should use custom software to monitor peer-to-peer networks for illegal activity, and he wants to spend $1 billion in tax dollars to help make that happen.

At an afternoon Senate Judiciary subcommittee hearing about child exploitation on the Internet, Sen. Joe Biden (D-Del.) said he was under the impression it's "pretty easy to pick out the person engaged in either transmitting or downloading violent scenes of rape, molestation" simply by looking at file names. He urged use of those techniques by investigators to help nab the most egregious offenders.

The software, dubbed "Operation Fairplay," was developed two years ago by Special Agent Flint Waters in the Wyoming Attorney General's Office, who, by Biden's description, is considered an expert in the field. The application is currently being used by all of the regional Internet Crimes Against Children (ICAC) task forces nationwide and internationally, Waters told the panel.

Don't panic, it looks like Biden is clueless and thinks you can just go off names. Looks like the FBI trolling P2P nets for kiddie porn, but importantly doing the verification and followup legally. It's what I'd expect from proper law enforcement.

How quickly will this be switched from catching child porn to doing the RIAA's bidding to arrest kids for copyright violations?

If it were only that easy. This guy is a clueless idiot. A lot of this stuff gets posted on imageboards, where pics are identified by a number, not a filename, threads are deleted after a certain amount of time to save storage space, and traffic is so high they are nearly impossible to moderate. Also, it's not that hard to hide offending content in a seemingly innocuous file. And I would guess the people involved are probably smart enough not to name their loli-pr0nz something obvious.

And I would be suspect that such a file is spam or contains malware.

Too, in most instances, one cannot tell just from the title whether a p2p file is porn or not, legal or not. Until the title is fully download, it is usually unreadable, as it has missing parts.

‘It’s for the children.’ Basically decent folk who can be dupe by that line make up a much larger part of the electorate than do sexual deviates (that is, unless you’re one of the sort who define oral sex between husband and wife and mastrubation as ‘sexually deviate’, in which case I suspect ‘sexual deviates’ make up a majority of the population.)

It’s OK to violate privacy to make sure record companies get paid, but it is a Constitutional crisis if we monitor foreign terrorists who want to nuke the US. Makes perfect sense....if you are a moron.

An even better idea - connect all those internet cameras to a permanent federal monitoring station, and maybe we can cut down on smoking and other retrograde behavior by sending little warnings, or even fines. I’ll write to my congressman right away!

If Biden is so concerned, maybe he should consider legislation against mobile/cell phones, too.

In the last few days, stories have hit the news about teens sending explicit pictures of themselves to classmates.

So, if a teen sends a pic of him/herself to another teen, is that child porn and which would be prosecuted? Or sould they both be prosecuted?

Maybe we should ban all mobile/cell phones. And computers. And cameras. And art supplies.

All this is going to do is hurt the people who respect the law. Even if a PC is hosting illegal stuff how do we know if it isn’t being used as a mule.
My daughter’s PC recently got very slow, the antivirus programs didn’t see anything wrong, but using low level disk tools (Western Digital diagnostics disk), I found a 4G hidden partition that was hosting a porn site. A small driver in the PC’s boot up sequence accessed it and fielded all internatet packets to and from the secret partition. Killing the driver and formatting the secret partition took care of it, but how many other people’s PCs are hosting similar hacker stuff or movies or music?

I understand the concerns. I ignored the lib politician in the article and read the parts from the FBI guy. It looks like they are trying to do this the right way: Identify suspect files, lawfully obtain a subpoena, conduct an investigation. In your case innocence was obvious. I can’t see how the FBI can be effective and not at least do this.

I think we’re so jaded by the RIAA’s tactics that any kind of monitoring of P2P networks sends up huge red flags.

Wiretapping is an invasion of privacy and thus needs legal authorization to perform. This is the equivalent of a guy on a street corner with a pile of CDs to give away and a sign showing all the files on them and their sizes. It isn't an invasion of privacy to stand there and read the sign.

That is a danger. The copyright cartel is constantly offloading its responsibility to enforce its copyrights onto the government.

We already monitor such sites. Sorry, but you have no expectation of privacy if you put up an open web site or use P2P, just as you should expect that anything you write here will be read by anybody.

Why? Anytime your traffic passes through a layer 3 gateway the MAC address is going to change.

Crypto P2P networks are the way to go about defeating this police state crap.

Crypto P2P networks are the way to go about defeating this police state crap.

That won't help in the current state if the FBI is one of the nodes. Other anonymization methods, such as having no direct file transfers, give everyone plausible deniability since any file they get from you didn't originate from you and there is no way you could have known what the file was.

Of course that wouldn't apply in a dedicated kiddie porn P2P network, since everyone is on it for that specific reason and should be arrested.

What problem do you have with a lawfully obtained subpoena for the user's identity, and then a search warrant for the user's computer? I do have concern that they may use jack-boot thug tactics, and I hope they do this knowing that this investigative technique is liable to produce false positives.
