Mexican to Plead Guilty to Smuggling (Ramos and Compean Case)

A Mexican national who was shot by two Border Patrol agents but later was charged with smuggling marijuana is expected to plead guilty to those charges today in federal court in El Paso, Texas, The Washington Times has learned.

Osvaldo Aldrete Davila, whose testimony against Border Patrol Agents Ignacio "Nacho" Ramos and Jose Alonso Compean led to their conviction in March 2006, was apprehended by the Drug Enforcement Administration (DEA) last year at the international port of entry in El Paso, after witnesses identified him in a second drug-smuggling operation.

Ramos and Compean are serving 11 and 12 years, respectively.

"He decided to take the plea," said a source close to the case who asked not to be identified because of the sensitivity of the case and ongoing appeals of the two border agents. "He admitted to the two loads. Davila is looking at six to 10 years."

Court records show that Aldrete Davila is scheduled to plead guilty at the federal courthouse in El Paso at 3 p.m. local time.

Murderers do less time than that. It's an outrage.

A 2nd drug smuggling episode that would have shattered Sutton’s star witness testimony, if it had been relayed to the jury.

You are right. Of course the argument is that Ramos and Compean didn’t know he was a drug smuggler and therefore such evidence could not be used by the defense. Those that argue this, believe that it’s proper jurisprudence to deny the defense the ability to argue that Aldrete was a career criminal while the prosecution is allowed to lie through their teeth and claim that Aldrete was just a poor victim of circumstance just trying to earn a little money for his mother. The “reasonable person” element was violated by the prosecution.

If this had gone to trial, old Osvaldo would have been wide open to questions about his connections with the BP, namely the mysterious René Sánchez. His reward for clamming up and pleading guilty: a very light fall. Deal smells bad. Real bad.

Relax Sutton, you're safe for the time being.

Then there is no justice ,, Bush continues to smirk about his border policy and tell the American people to pack fudge ,, Sutton is in the clear hiding his deception in the haze of beaurocratic incompetance and will be presumably until the Bush term is over ,, and after letting Compean and Ramos sit in jail for a few years Bush sure put his messsage across loud and clear,, Can the Judge reviewing the evidence at C&R’s appeal take this into consideration? ,, He’s been sitting on a decision for over 4 months.. Did he know this deal was in the works?

Um, no, make that the second one he got caught on. And you can bet if he gets convicted, he'll have all sorts of post tramatic episodes and complications from the shooting which will cost the taxpayers.

I noticed on our income tax we could donate a dollar to the presidential campaign but I didn’t see anything on there to deny the dollar until the a presient releases them.

Teach, there is no way Osvaldo will do even 6.

I predict he will be remanded into Mexican custody and be free as bird well within 18 months. By copping a plea, Osvaldo has done some very powerful people a big favor.

I recall the hundreds of posts here at FR saying he wasn't a "smuggler," just a poor "mule" -- totally unbelievable given what facts we do know.

Totally unbelievable on its face value. I doubt "professional" drug dealers would entrust such a load to a rank amateur. I think the trial testimony points to a long relationship with the drug trade. That "chance" meeting Davila had with Rene Sanchez in Reynosa, Mx in 2004 is really fishy.

Thanks for the ping, cc-girl. I caught Lou Dobbs tonight when he had Johnny Sutton on. Anyone who read the trial transcript knows that Sutton was distorting in some instances and out right lying in others. He is a slime ball that should have been gone when his incompetent pal Al Gonzales resigned.

He is still smearing Ramos and Compean, saying that they had destroyed his case against Davila. He neglects to explain how they did that, since they captured the van with the 700+ lbs. of drugs and they visually saw Davila escaping. And Sutton shows no remorse that his incompetence allowed Davila to continue to run drugs, on a pass provided by Sutton's office, during the trial phase.

Sutton has apparently done the same thing with Davila that he did in the “House of Death” debacle; he settles so that there will be no open court testimony that will show the corruption of the Sutton operation. Sutton claimed there was no deal, but Davila only got 8-10 years [less than the agents who attempted to apprehend him!] and yet I heard he was eligible for much more. Smells like a deal to me.

It is generally recognized that Sutton's prosecutors lied in court and tried to cover up the extent of Davila’s drug involvement. Gee, lying and cover up? Isn't that what he charged the Agents with? Guess it is okay for Sutton to lie and cover up, but the US Border Agents better not try it.

If Johnny Sutton is so concerned with corruption, I think he should first start looking in his own office!

A drug smuggling event that Sutton was hiding from the jury by pretending it was “being investigated”. Like hell. Sutton is as dirty as Mike Nifong, and he belongs in prison.

Sutton could care less if Ramos and Compean ‘spoiled his case against Osvaldo’. And that’s because Osvaldo never was Sutton’s target. The two Border Patrol agents were the only people he was interested in sending to prison. And he intended to do that no matter how much he had to perjure himself in the process.

You missed my point. Sutton is saying that to further impugn the Agents. You are right that Sutton's target was the Agents and not Davila. It was only after Davila’s action became widely publicized that Sutton was forced to take action against Davila.

This has been Sutton's pattern right along. His grand schemes to be the next Elliot Ness crumble because of ethical missteps and then he throws the good guys to the wolves and pleads down the bad guys, all to cover his own ineptness.

Of course there is always the “Manchurian Candidate” theory. Or should I say the “Mexican Candidate”?!

That’s good. And if Sutton had prosecuted him instead of border agents, he’d have pled that one too, instead he got a border pass and $800,000 (IIRC).

No, sorry, that won’t fly. No one would know about this or most immigration problems if not for Lou Dobbs. You’re barking at the wrong guy, or are you for open borders? No one has been harder on Sutton or defended Ramos and Compean more than Dobbs. As for his guests, I don’t know about you, but I want to know what my enemy is saying, or would you rather take someones word for it?

I agree with you totally, AuntB. Lou Dobbs deserves our thanks for keeping the Agents’ plight before the public. Were it not for Dobbs, Sutton and his cronies would have swept this injustice under the rug with their other ones.

Lou Dobbs ran a second segment on Ramos and Compean tonight [Friday] in which it was suggested a deal may indeed have been cut with Davila. [Sutton denied it yesterday.] The reporter pointed out that Davila could/should have received a harsher sentence both for the number of drug smuggling runs he made and because he violated the terms of his original immunity which usually earns a culprit a stiffer sentence.

But, it turns out a judge has leeway to offer a more lenient sentence to a person who cooperates with the Government. Since, apparently, it was the same judge as in the first trial, one has to wonder what kind of cooperation was expected from Davila? Was it not to spill the beans on the unethical way Sutton handled the Ramos and Compean trial?

You bet!

What a dirty double-dealing place the Southwest has become as the result of this invasion. Sutton of course, wants the absolute minimum of light shed here. God only knows what the heck is going on behind the scenes in the appeals court.

One possible explanation: Sutton is working around the inevitable release of R and C, and building a sort of post-facto case against them so that his office can escape ... or at least mitigate... any consequences in the civil actions that are sure to follow.

So, where's the appeal verdict?

Hey, Kenny Bunk. Good to hear you opine. Know you were saddened by the passing of WFB and my thoughts and prayers go out to you and to others touched by his life. He was such a gift, and, sadly, very much under appreciated by many who were not Conservatively inclined.

I think one of the reasons that the Pope has received such an enthusiastic reception is that he is a man of principle and character. Whether one is Catholic or not, you have to admire the guy.

And his timing could not be more fortuitous. Right in the middle of a political campaign so fraught with lies that most Americans don't believe what the candidates say anymore. [If they ever did!]
