The ACLU of Colorado has filed a federal lawsuit against the U.S. Secret Service and the city of Denver to ensure that protesters are within "sight and sound" of delegates attending the Democratic National Convention this August.
"Ultimately, it's the federal courts that are sort of the last resort protectors of constitutional rights," Mark Silverstein, the ACLU's legal director, said today.
"It's been the federal courts that are the ones to say law enforcement has not struck the proper balance here between security concerns and citizens' fundamental First Amendment rights," he said.
Silverstein said the city is dragging its feet on processing applications for parade and park permits, affecting protesters' planning efforts, and that it has yet to reveal where the so-called free speech zone will be located.
The city says it's waiting for the Secret Service to determine the boundaries of a security perimeter, and the Secret Service says that decision may not happen until July, he said.
No one has been denied a parade permit. No one has been denied the right to protest," City Attorney David Fine said today in statement.

I’m with you.
Let the Riots begin.
It is like the perfect storm is brewing. ACLU, Democrats, Democrat radical protesters, Florida and Michigan Democrat congress critters and unseated delegates threatening to shut down the convention, Clinton and Obama in a self-destructive fight to the end.
Let me understand this one. ACLU is suing IN ADVANCE of anything actually happening??
Sounds like Denver (and any future convention city) is faced with the equivalent of “Have you stopped beating your wife, yet?”.
If they take the prudent step of protecting its citizens, they will face law suits. If they allow every crazy to express his “freedom of speech”, anarchy rules and the residents have every reason to sue the city for damages.
The 1st Amendment’s free speech clause is NOT absolute, as the courts have repeatedly ruled. It does NOT give you the right to yell “Fire” in a crowd; it does NOT give you the right to make threats, or yell “Hi Jack” in an airport, etc.
Given that it is NOT an absolute right and nothing untoward has YET occured, where is the crime? Or have we reached the point that we can sue for what MIGHT happen?
Sorry, as usual, ACLU is on the wrong side of the tracks.
Denver had a lottery for different groups to occupy different parks. The permits are 1-day permits and many parks are not close to the Pepsi Center where the delegates will be. The groups are not all radicals. One group is a pro-life group and one group is the DNC welcoming committee. The radical group Recreate-68 wanted the park right next to the Pepsi Center, especially for the 1st day of the convention. In the Denver lottery the R-68 did not win the drawing for the park next to the Pepsi Center, thus the law suit. I hope they win. It would be great to see the Democrats meeting their left-wing base on national TV.
They want to be able to riot within full view of the TV Cameras, instead being hidden MILES AWAY inside of the Civic Center, with police guarding the exits...
What happened at the Washington state capitol yesterday is just a taste of whats in store for Denver and the DNC.
So the ACLU believes there is a right to be heard. That’s a new on on me. BUT...in this case, more power to social retards.
Employment at popcorn counters *alone* accounts for most of this recovery.

To All: If you want to get sick, look at the Recreate 68 website. The Rats deserve the very best.
Hell with that, Let em' inside!
Let’s hope some of the anarchists from Evergreen state college in Washington state show up. The ones in hoods and black bandanas covering their faces.
Then the party really gets started in Denver.
The RAT convention is going to be the ultimate cage-match!
Operation Chaos exceeding ALL expectations...
That is an absolutely brilliant idea! I like it!
Almost.
But I'd definitely watch!
“I hope the ACLU wins this one. Never thought I would find myself saying that!”
Thx saved me from typing .
We need to start a legal bulwork that finds a way to sue the ACLU directly (i.e. go on the offensive, initiate fact-finding missions, keep them tied up fighting lawsuits that never end, etc). Sort of a new twist on “Operation Chaos.”
“If they let them in, I’d almost pay to watch”
Somebody needs to have some LSD handy as they go in.
A very astute, succinct summary. Well done.
WELL!!! The Democrats are supporting BIG SODA!!
COWARDS!!
This is great...this could become the GO signal.
It just keeps getting better.
This can’t be! It’s Rush Limbaugh who is going to cause the riots...not those peace-loving lefties.
/s/
Thanks for posting some good, accurate information.
That said, having a family member with DPD, I’d rather not see any riots, personally. I think we’re forgetting that some people will be hurt and some may even be killed in these riots. The anarchists did a similar one in Italy a while back and managed to hit a policeman with a Molotov cocktail.
When they had a bunch of leftist/anarchist protests in Denver (I can’t even remember what it was about!) a year or two ago, the police collected weapons and parts of weapons of all kinds that had been hidden around the protest area by sympathizers already in Denver. Some were things that had been broken down into parts to be assembled by the “protester,” who would clearly have been informed in advance where the parts were located.
These people are not your old-style “shout and scream and maybe throw some rocks” protestor.
Chaos. Please just call it chaos.
I agree. If the leftists just make fools of themselves that is one thing. I worry for the DPD, Secret Service, Denver residents and property owners. I really don’t think DPD should show much restraint in the face of threats that have been made. If I was the mayor it would be like this: “First two rounds are rubber bullets, all the rest are real ones”.
That's why the ACLU is suing. It is a radical organization and so it wants a revolution at the Democratic Convention.
"Recreate 68"...what a great concept...
they must be REALLY radical, b/c IIRC, 1968 was a bad year for liberals...anyone remember MLK and RFK?
(of course, I was not yet born...)
Just look at Recreate 68 website-you can Google it. I was alive in ‘68 and it was an ugly year. Tet, USS Pueblo, Soviets invading Chech., MLK, RFK, Riots, etc.
May the Dem convention in Denver make Chicago ‘68 look like a tea party.
The ACLU supports Operation Chaos!
“The ACLU of Colorado has filed a federal lawsuit against “
Has any court agreed to this? I don’t think you can file if your aggrieved party exists in the future, aggrieved by an event that has not happened yet.
Then again, ACLU has helped define so much in our court processes, this may be old hat.
The power belongs to the young people and the black people in this country...we gotta build a strong base.2008?
No.

Denver deserves riots, anarchy, vandalism, and serious injury. Welcome to the national exposure of hooligan America.
I don't, they are just getting what they asked for.
Works for me, but I sense a lack of sack in Hick.
Bad for the Viet Cong!
Sorry, but DPD did NOT ask for this. I have family on the force, and I am really sorry you are viewing it this way. Hickenlooper is a jerk, but he’s less of a jerk than some of the others who could have been elected.
These rioters are dangerous. The police were tipped off the last time and seized van loads of weapons heading towards Denver. They also found disassembled hidden weapons scattered all around the “protest” area, and spent all night cleaning out the shrubbery. They had stacks of weapons and devices by the time they were done.
Maybe everybody here should take a deep breath and THINK before they call for riots. Would you call for more al Sadr action in Iraq? I thought not.
All the wine drinking libertine liberals with Obama and Hillary stickers on their mobiles will have all these horrified looks on their faces when they see all the riots & anarchy in Denver. Its those types of moments when it hits them like a shotgun blast to the gut exactly what the true nature of the democrat party is and has reaped with its agenda of pandering to every fringe group out there for votes.
Yes, Hickenlooper is already having restraint training for the Denver PD. That will surely scare the anarchists!
I agree that Hickenlooper is nowhere near as bad as Webb. He is very naieve about these leftists. I heard him on the radio saying he did not understand how these people could become violent (being leftists and against the war and all that). I do have an intense dislike of Gov Ritter the critter. He should be out in front catching the brunt of whatever happens. The Denver PD and the citizens of Denver just had this foisted on them by DemocRAT politicians thinking they could swing Colorado to a Blue State.
What happened in Olympia? I looked at the Seattle Times and didn’t see any mention of anything. They did mention the communist May celebration in Seattle, though.
Maybe they should consider a police strike.

No kidding. It's time that the Denver lefties found out about this in a way they can't ignore.
Would you call for more al Sadr action in Iraq? I thought not.
I'm sure that the Maddi militia would do as I say, as opposed to the leftie Rat traitors in and headed for, Denver.
