HIV-positive man gets 35 years for spitting on Dallas police officer
Dallas Morning News ^ | 05/15/2008 | By TIARA M. ELLIS

An HIV-positive man with a history of spitting at police officers and biting fellow jail inmates was sentenced to 35 years in prison Wednesday.

Willie Campbell's sentence came one day after the same Dallas County jury convicted the 42-year-old of harassment of a public servant for spitting into the eye and open mouth of Dallas Officer Dan Waller in May 2006.

As Mr. Campbell was being arrested for public intoxication, he began to resist and kicked at the computer screen in the police vehicle, Officer Waller testified during the two-day trial.

"He turns and spits," Officer Waller said. "He hits me in the eye and mouth. Then he told me he has AIDS. I immediately began looking for something to flush my eyes with."

During Tuesday's guilt/innocence phase of the trial, Mr. Campbell testified in his defense and offered to enter his feet as evidence to prove he did not kick the squad car's computer screen, said Aja Reed, a prosecutor who worked on the case.

-snip-

Officer Waller said he was elated with the jury's decision.

"I know it sounds cliché, but this is why you lock someone up, so our streets are safer," Officer Waller said. "Without him out there, our streets are a safer place."

No word on whether or not Officer Waller contacted AIDS, so he's lucky.

But.... 35 years? Excessive?

Serial rapists and murderers routinely get lighter sentences.

Attempted murder of Policemen tends to carry a harsher sentence.

If it was just for the spitting then it would be OTT, but the article mentions that he was biting people as well. Spitting won’t spread HIV but a bite that breaks the skin could.

"But.... 35 years? Excessive?"

It's hard to know what's appropriate. But to me, what he did was tantamount to attempted murder, so I have no sympathy for him.

As for serial rapists and murders... well, such people should never see the sky again.

What was he doing in the front seat so that he was able to kick the computer screen in the squad car?

“Serial rapists and murderers routinely get lighter sentences.”

And that is the problem, that rapists and murderers don’t get more than 35. His actions could have resulted in the death of the officer. He deserves it.

Serial rapists and murderers are getting off lightly.

I would guess that attempted murder of a police officer carries all kinds of special circumstances with it.

Lucky? Nah... odds of him actually contracting HIV from such an act is very very slim... The risk of HIV is insanely low, even when HIV is directly exposed to the bloodstream it still has a very low incident of infection.

I forget the numbers, but the likelihood of you getting HIV if you are stuck by a needle that was used by an HIV+ person is only 1 in several hundred.

I’m not condoning what this guy did, but the risk of truly transfering HIV in such a manner is very very very very very low.

In Texas they do everything Super Sized. A thirty-five year sentence is merely the Texas way of saying “welcome back to the Penal System, pardner! Y’all come and set here for a spell...”

Oh I’m not saying you can’t get it, I’m just saying the odds are fortunately very very low. If they weren’t things would be dicey.

Fearmongering over its transmission rates however are needed to keep the gay lobby getting the money they want so they can work toward medical help, instead of having to stop engaging in anonymous sodomy with multiple partners, particularly when high on drugs or in public places.

Frankly the dollars spent on HIV/AIDS research are insanely disproportionate to the threat. They should be cut drastically and moved to things that truly do hit large numbers through no actions of their own.. like breast cancer. If the money spent on HIV had been spent on Breast Cancer, there’d be a lot more sisters, mothers and grandmothers who would be walking this earth.

So will he get ANOTHER 35 years the NEXT time he BITES another inmate? Or is that just bad behavior between a BUNCH of ne’er do wells?

The good/bad thing about Texas is that the jury determines sentence. I had a guy who stole a $10 watch and fought the store security. He was charged with Aggravated Robbery and plead guilty to the judge. She gave him 10 years because of his priors. He felt that was too long so he withdrew his plea and went to jury trial. The jury convicted on a lesser charge because it was a $10 watch. During the sentencing phase the jury got to see his record and it ticked them off that they went easy on him and handed him 80 years.

Moral of the story, Don't mess with Texas.

> So will he get ANOTHER 35 years the NEXT time he BITES another inmate? Or is that just bad behavior between a BUNCH of ne’er do wells?

Spitting is a filthy habit, as this mungrel’s Mum should have taught him long ago. Spitting at a cop is Disrespectful — as his Mum should also have taught him long ago. HIV is a filthy disease to carry, and is usually (tho’ not always) the result of filthy habits — and this is something that his Mum should also have taught him long ago.

And she probably did.

And so this mungrel is being given a Texas-sized welcome to the Hoosegow primarily because he did not pay attention to his Mum: good manners, Respect and good hygiene are important life skills to have and to develop early.

Thirty-five years in the Crowbar Hotel may sound like a long time, but hey — it has taken him this long already and he hasn’t learned basic good manners and courtesy: why should anyone believe he can do so anytime soon? Or at all? And if he needs another 35 years to get it right, well, it just proves the point: he’s a slow learner that ought not be hurried.

The other prisoners he is likely to mix with will be there for good reasons and will probably similarly have Texas-sized sentences. They can no doubt look after themselves admirably if this mungrel tries to bite them.

I see no problems here.

The libs on CNN are livid over this.

The police officer should have accepted the spit as a token of love from a gay man....... Sarc..

Officer Waller said he was elated with the jury’s decision.

“I know it sounds cliché, but this is why you lock someone up, so our streets are safer,” Officer Waller said. “Without him out there, our streets are a safer place.”

Yep.

It’s obvious this moron is intent on leaving his AIDS legacy to another person. How he goes about it is irrelevant.

35 years isn’t long enough.

He spit in the officer's eyes with the intent of infecting him with AIDS. Since AIDS is incurable, that assault was with the intent to kill. The sentence is just fine. More sentences like that will discourage AIDS infected individuals from spreading there incurable disease to others.

Why should the taxpayer shoulder that burden? Let nature takes it's course. That's what he wanted for the cop.

Once he gets to prison and starts spitting his HIV-riddled saliva on the other inmates, he may not last long.
