Gay marriage legal in California, court declares (Just In)

SAN FRANCISCO - A deeply divided California Supreme Court legalized gay marriage in an opinion issued Thursday morning.

Wild cheers echoed throughout City Hall and other spots where proponents had gathered Thursday morning awaiting the opinion, which came on a 4-3 vote.

The case stems from challenges to state law by gay couples who were married in ceremonies at San Francisco City Hall in 2004, when Mayor Gavin Newsom began issuing marriage licenses to same-sex couples.

Legal challenges to those marriages eventually led to the high court invalidating them six months later. California voters already had approved by a wide margin a measure in 2000 that declared marriage to be only between a man and a woman.

A court cannot make law, they have overstepped their authority.

Ahnold should say, they have declared it, let them enforce it, not one tax dollar nor government worker will be spent on such things.

Was a time we had leaders like that in this country... long gone anymore.

Mayor broke the law so the state supreme court changes the law to suit the law breaker. Doesn’t matter which side you are on, Americans are finished if they don’t care the courts keep changing their laws without a vote.

Well, there’s a movement in the works to have a constitutional amendment in Calif. to define marriage. It could be voted on in November.

This also forces people to take a stand. Some people have opposed these marriage amendments in other states because of reasons such as, the law already defines marriage, an amendment isn’t needed, federal law already defines marriage, for example. Anybody who thought an amendment wasn’t needed in California because the law already defined marriage was proven wrong today. The law defined marriage as 1 man 1 woman, whereas in Mass. the law didn’t specifically say that marriage partners have to be opposite sex. So now activist judges are willing to overturn laws that define marriage as 1 man 1 woman. The only way to define marriage will be a constitutional amendment.

Although he probably won't even realize it.........

THIS IS IT. This is the issue that can literally WIN THE ELECTION for McCain. If he were to immediately issue a strongly worded statement right now, saying that this decision represents judicial activism at its worst, and that this is precisely the kind of ruling that any judge that he would appoint would NEVER MAKE (and would overturn if given the chance), it would be a humongous boost to his campaign - especially among suspicious social conservatives.

Even more importantly, it would force BHO to react to an issue that is toxic for him. He agrees with the ruling - he's a radical that's out of touch with mainstream America; he's against it - he ticks off his base and is no longer a "uniter".

But then again, JMcC will probably turn this (somehow) into another attack on conservatives!

Those who point out how this will help Republicans are absolutely right. McCain and other Republicans need to take a strong moral stand against gay marriage and other attacks on the American family.

This campaign can be defined by two issues: Morality and the War on Terror. If the Republicans stick to them, pointing how Dem weakness on these issues endanger America and all Americans, they can Win.

I have a law degree (two of them actually), but this is not my area of law. However, under the full faith and credit clause it means (I think) that other states would have to honor gay marriages that were performed in CA.

This is a huge election issue gift that the left just handed us if the republicans play it right. It is huge IMO.

If McCain plays this right, he can beat the s##t out of Obama with this issue. I am sure Obama will come out with the standard democrat lie/playbook: he personally is against gay marriage but he thinks people should have the right to marry if gay. It is the same playbook the democrats use to get around the aborotion issue, which they are now on the wrong side of. John Kerry would say he is personally pro-life but supported the right of others to have an abortion. A bunch of lying BS.

I’ll throw my JD and license into the mix: Full faith and credit will not need to be accorded because of the Defense of Marriage Act that Clinton signed. The obvious vulnerability of DOMA to federal judicial action is why the federal Marriage Amendment was proposed.

My sense is that it gets appealed to the Federal System and that means it goes to the Ninth Circuit which most probably will uphold it and then on to the US Supreme Court. Over its course, there are three to four US Supreme Court justices that may be retiring during that time period so depending on who you vote for, those justices become pretty important. For all of those who are contemplating staying home in November, it’s pretty clear, your abstinence will be a vote for the opposition depending on which side you are on. If you are staying home from the polls in November, you will be casting a ballot in favor of the other side on this issue no matter which side you are on...so VOTE!!! Hold your nose and VOTE!!!!

There has been floating rumors of Huckabee being the VP. A US constitutional amendment has been one of Huckabee’s big issues.

Supposedly this can’t go to the Supremes because this is a state issue. Now Judge Napolitiano was saying something about that the CA Supreme Court could also shoot down the CA constitutional amendment, it has to be a US one.

With the recent court ruling on homosexual “marriage,” the already far lower than required population replacement rate of 2.1 kids per white, native born family will now head even lower. (In case you hadn’t noticed, homosexual couples produce very few offsping.)

If you can get to Mexico, don a sombrero, a serape and simply stroll across the unprotected “Bush” border at San Diego. Immediately apply for welfare and get down to the serious business of full time breeding.

Then in 20 years — or less the way things are going out there — you can duke it out with the illegal Mexicans for dominance of the place, thus establishing a perfect springboard for whatever terrorist mischief you care to perpetrate on the rest of the land mass that used to be known as AMERICA.

But by then, you’ll probably not even have to bother because, as we all know, as goes Keliforrnia, so goes the nation.

We’re doomed.

While I would like to get a very solid, young conservative as a VP, Huckabee is very articulate and a great speaker/debater (better than Obama IMO) and he could pull in the social conservatives and fire them up. He may not be a bad choice for VP.

Courts don’t care about the Constitution. Courts don’t care about the will of the people. Courts don’t care about right and wrong.

Obviously some judges need some reeducation on the Constitution. The court’s job is not to MAKE laws.

From the AP article. You know this is exactly their intent. This is the basis in which the gay agenda will move their case immediately into all fifty states. If you are legally married in California, and that means married, they will sue in all fifty states to invalidate your laws or even your state constitutional amendments under Federal law. This just cleared the way to go to the Supreme Court to mandate gay marriage the way Lawrence V Texas killed the state's rights to regulate sodomy.
This should be a campaign issue. It does affect everyone.

I do not have a law degree but have family full of them(good enough for my standards).
Without going in to detail, this could potentially have huge ramifications on the definition of “Family” in the eyes of the law. Parental rights,the education system,and the overall governmental intrusion in to private lives of traditional families might be intense.

Newsflash for you buddy, it is the President that sets policy for his administration and John McCain is solidly against a Marriage Amendment to the Constitution.

You see he can't keep his "Maverick" title and support something so morally correct and common-sense as that conservative position on that issue.

Sames sex couples married in California will have same family status in all 50 states who do not have gay marriage. Much like your drive’s liscense be recognized in other states, so will your marriage license.

Why do so many assume that McCain will appoint real Conservative/constructionist judges? He was one of the traitors that enabled the Democrats to obstruct the appointment of strong constructionist judges over the last 7 years.

Once again, we are making the wrong argument, and therefore will lose the war (even though we win all the battles).

The WRONG here is the seizure of power from the People to legislate as they see fit.

The issue of two men or two women pretending to be "married" is not what's at issue here. THAT issue was won with the voters of California, and re-arguing it here, under these circumstances, has NO CHANCE of changing the outcome.

What needs to be put in front of the People now is NOT how we feel, or think they should feel, about homosexual "marriages" or other homosexual behavior.

The People need to understand that this ruling is an illegitimate seizure of THEIR OWN POWER TO GOVERN THEMSELVES.

This has the advantage, once that battle is won, of putting an end to these rulings once and for all. If, in ten years and after ten billion dollars, you are able to amend the California Constitution, they'll just be back in court with gay scoutmasters, or polygamy, or heaven knows what.

Defeat the problem at it's source - end legislation from the bench. If you amend the Constitution to do THAT, there's a victory worth having.
